近年来，随着网络信息技术的迅速发展，网络游戏已经成为我国公民日常生活中最重要的娱乐手段之一，虚拟财产交易的也随之产生。由于我囯尚缺少专门调整网络行为的法律规范，虚拟财产交易基本独立于法律约束的范围之外，导致现实中呈现出虚拟财产纠纷层出不穷、解决困难且救济机制匮乏的状态。将虚拟财产纠纷的解决机制列入法律规范的调整框架下，是我国网络娱乐业发展的需要，也是完善我国法律体系建设的重要步骤。本文从虚拟财产的法律定性上出发，结合近年来国内各方学者的观点及对玩家心态的调查，借鉴境外国家或地区较成功的虚拟财产立法经验，设计一套简便有效的虚拟财产保护机制，并就虚拟财产交易各方的归责原则、权责划分提出自己的建议。

Recently, with the rapid development of modern network technology, game is becoming a very important method for entertainment in people’s daily life,this is the origins of virtual property exchanges. For the lack of legal rules in regulate the particular network behaviors, virtual property exchanges is out of the restrict of laws, which leads to the contradiction and problems of more of virtual property exchanges dissensions、settled less and more difficulty in remediation. As the important approach of the perfection of Chinese law system, list the virtual property exchanges into Chinese law system is also one of the requests of the development of net games. The article focuses on the definition of virtual property in law,combine with viewpoints of domestic scholars, through the survey of players psychology, by reference the successful methods abroad, design a effective system of virtual property protection. Meanwhile,the author’s suggestion on responsibility ascription of each participant in virtual property exchanges was shown.
