附条件不起诉制度的适用范围问题自该制度于2012年进入《刑事诉讼法》以来便广为学者关注。在当今我国进入轻罪时代，最高人民检察院推行“少捕慎诉慎押”司法政策的背景下，各地检察机关相继探索引入附条件不起诉制度治理“醉驾”类轻罪案件，扩展附条件不起诉制度的适用范围助力于轻罪治理已经具有现实可行性。基于上述政策和理论背景，笔者尝试扩大附条件不起诉制度的适用范围，构建轻罪适用附条件不起诉制度。笔者通过对“少捕慎诉慎押”司法政策进行解读，对引入附条件不起诉制度治理“醉驾”案件的实践情况进行分析，对德国、日本、美国的附条件不起诉制度进行借鉴后，最后从适用范围、适用条件和监督考察三个方面具体完善现行附条件不起诉制度的设计，以期为轻罪治理提供新的思路。

The scope of application of the conditional non-prosecution system has attracted widespread scholarly attention since the system was introduced into the Criminal Procedure Law in 2012. Against the background of our country's entry into the era of misdemeanors and the Supreme People's Procuratorate's implementation of the judicial policy of "fewer arrests, more prudent prosecutions, and more prudent detentions", procuratorial organs in all regions have explored the introduction of conditional non-prosecution system to manage "drunk driving" type of misdemeanor cases, expanding the scope of application of the conditional non-prosecution system to help the management of misdemeanors is already practicable. Based on the above policy and theoretical background, the author tries to expand the scope of application of the conditional non-prosecution system, and construct a system of conditional non-prosecution for misdemeanors. After interpretating of the judicial policy of "fewer arrests, more prudent prosecutions and more prudent detentions" , analyzing the practice of introducing the conditional non-prosecution system to deal with "drunk driving" cases and making reference to the system in Germany, Japan and the United States, the design of the current conditional non-prosecution system is improved in three aspects, namely, the scope of application, the conditions of application and the supervision and investigation, with a view to providing a new way of thinking for the management of minor crimes.
