“土地利用规划”是指政府为维护某种社会公益目的对土地使用加以规划和限制,以协调不同的土地使用主体之间的冲突,实现利益平衡的一种行政规划手段。“土地利用规划法律制度”则是将此种土地利用规划的规范层级、权力配置、基本原则和实施程序等加以明确的法律规范的总称。当前我国土地利用矛盾突出,存在着各类规划之间效力层次不清、规划稳定性不强、相对人利益缺乏保障等问题。从法理学视角系统思考中国土地利用规划法律制度,是深入挖掘这些问题成因及其解决方案的重要手段,也是法学理论面对中国问题、提炼本土法理的粗浅尝试。除去结论部分,本文主体结构共分为五章:
第一章,绪论部分分为四节,第一节论述了论文的缘起和选题的背景及意义。第二节对于这一选题现有的国内外研究进行了简要综述。第三节通过相关概念的界定,确定了本文的研究范围。第四节着重论述了本文所采用的研究方法及在学术视角、学术观点和资料选择上的创新性。
第二章,为社会变迁与土地利用规划法律制度的演变。法律因社会变迁而不断演进,研究社会变迁与法律演进的历程,不仅能够更加深刻地理解法律理论问题,也能够更好地指引法治实践。现代意义上的土地利用规划法律制度因社会变迁而生,在城市化高歌猛进的大背景下不断演变。宏观层面勾勒社会变迁与土地利用规划法律制度的历史演变,也是研究当代中国土地规划法律制度无法回避的问题。本章分为三节。第一节重点研究土地利用规划法律制度如何兴起。从宏观视角看,土地利用规划法律制度诞生和演变的历史进程表明,政府干预和资源配置等政治、经济学理论为政府的土地规划权力提供了合法性证成,为土地利用规划提供了合法性基础。第二节讨论城市化背景下土地利用的法律控制的强化。从深层次讲,公民财产权保护与政府规制权之间的复杂博弈是土地利用规划法律制度发展演变的内在动力,运用法律控制政府土地利用规划权力成为保护公民财产权利的重要方法。第三节探讨了我国土地利用规划法律制度的历史演变,从建国初期的鼓励开垦,到经济发展过热造成的调控失效,最后到土地法律制度确立和土地用途管制最终形成,中国的三次土地法律制度的修改也恰恰是与中国城市化发展的三个阶段相对应。
第三章,我国土地利用规划法律制度的规范与价值分析。对我国现行土地利用规划法律制度体系的研究不能止于简单地进行法律规范的罗列,而是应当研究各个层级的法律是如何共同作用,并形成了系统规范。与此同时,对规范的分析还需要和应然层面的法律价值与原则相比照,从而发现问题。本章共分为两节,第一节厘清了土地利用规划的法律渊源、土地利用权力体系的结构和层次、土地利用规划法律关系和土地利用规划法律制度的基本原则等问题。从静态上来讲,土地利用规划法律制度包括法律、法规、规章、地方性法规等建立的制度体系;从动态上来讲又包括土地利用规划编制与审批管理、土地利用规划实施管理和土地利用规划监督三大组成部分。整个过程联系紧密,又各有特点。本文归纳了土地利用规划法律制度应当追求的目标与价值。结合法的价值与土地利用的特性,将土地利用规划法律制度的价值总结为:公平正义价值、生态价值、秩序价值和效益价值等几个方面。第二节主要论述了土地利用规划法律制度的几项基本原则,包含稳定性原则、合法性原则、比例原则和程序正当原则。
第四章,为我国土地利用规划法律制度的运行现状。对土地利用规划法律的现实运行状况进行了描述,总结我国土地利用规划法律实践中出现了哪些问题,其成因为何。本章共分为四节。第一节对土地利用规划法的总体运行状况进行了考察。第二节具体分析了土地利用规划法律制度运行中的冲突问题,包括多种规范之间的冲突、各类规划之间的冲突等。第三节综合分析了现行土地利用规划过程中的利益冲突问题。其矛盾冲突的根源在于土地利用价值巨大,现行规范导致了土地利益分配不均,无法实现增值收益共享的最佳状态。第四节对土地利用违法类型及其典型案件进行研究,通过具体案件的分析对土地利用规划的可诉性、违法的救济等问题进行了探讨。本文选取了三个较为典型的案件,其中第一个案件的分析了何种相对人能够成为土地利用规划行为的利害关系人;第二个案件说明了土地利用规划与土地利用总体规划的区别,在于前者在一定的违法前提下具有可诉性,而后者由于其针对不特定多数人而具有而不具有可诉性。到第三个案件进一步讨论了何种程度的程序违法,才会导致具体的规划行为被撤销和无效,从而引起行政法律救济。
第五章,是我国土地利用规划法律制度的完善建议。根据以上分析,提出对于我国土地利用规划法律制度的完善建议和设想。如前所述,土地利用规划先天具有高度利益冲突的色彩,虽然行政机关制定土地利用规划的目的在于促进公共利益,但仍然难免对各方利益难以平衡取舍。为了应对上述在行政程序中各利益主体的矛盾与冲突,本文通过论述土地利用规划与社会变迁的关系、我国现行土地利用规划法律制度的规范与价值、并结合对于该法律制度具体的运行效果的考察,提出土地利用规划法律制度完善的四点建议。具体包括法律体系的完善、冲突的协调、利益的平衡、规划的救济等四个方面。

“Land use planning” is a kind of administrative plan, which means that the government needs to plan and restrict the use of land for the public interest, the social economic development and the environmental protection, so as to coordinate the conflicts between different land-use legal subjects and realize their balance of interests. The "legal system of land planning" is a general term that defines the level of land-use plans, the allocation of power, the princeple and the procedure of land use regulation. At present, there are some problems, including the prominent contradiction of land use, the unclear level of effectiveness between various kinds of planning, the weak stability of planning and lack of protection of relative person’s interests. The following three factors should be to blame for the problems: the status of land use planning is not clear; the legal system is not perfect; and the law of land use planning requires immediately improvement. The practice and the history of land using planning show that the planning and restriction of land use can be helpful to regulate the land-use relationship, meet the needs of economic development, such as urbanization, the rational distribution of population and the development of construction. It is an important legal system in modern countries. The main structure of this paper is divided into five parts, excluding the conclusion:
The first chapter is the introduction, including four sections. The first section discusses the background and significance of the topic selection. Section two gives a brief overview of the existing domestic and international research on this topic. Section three defines the scope of this thesis through the definition of relevant concepts. Section four focuses on the research methods adopted in this paper and the innovation of the academic perspective, academic viewpoint and material selection.
The second chapter is the evolution of the legal system of social change and land use planning. Legal system evolves as a result of social movement. In the process of social change and law evolution, it can not only help to understand the legal theory more deeply, but also guide the practice of rule of law better. In modern sense, the legal system of land use planning arises from social changes and evolves in the rapid development of urbanization. To outline its historical evolution at the micro level is also an unavoidable problem to study the legal system of land use planning in modern China. This chapter is divided into three sections. The first section focuses on the rise of the legal system of land use planning and shows that the fundamental reason lies in the legal and reasonable restriction of land rights. The second section is about the legal control of land use in various countries under the background of urbanization. The third section discusses the historical evolution of the legal system of land use planning in China.
The third chapter is the norms and value analysis of the legal system of land use planning in China. The research on the current system of land use planning in China cannot be simply listing the legal norms, but should also study how the laws at all levels work together and form the systematic norms. At the same time, the analysis of the norm also needs to be compared with the legal value and principle of the corresponding level so as to find the problem. This chapter is divided into two parts. Section one clarifies the legal origin of land use planning, the structure and level of land use power system, the subject and object of the legal relationship of land use planning, as well as the content and power structure and principle of land using regulation. Including stability principle, legality principle, proportionality principle and procedural justice principle. From a static point of view, the legal system of land use planning includes the systems of laws, regulations, rules and local regulations. Dynamically, it consists of three parts: the management of establishment and approval, of the implementation, of the supervision. The whole process is closely connected but each has its own features. Section two deals with the goals and values that the legal system of land use planning should pursue. Combined with the value of law and the feature of land use, its value can be summarized as the value of fairness and justice, the value of order and thee value of benefits.
In the fourth chapter, the present situation of land use planning law system in China is discussed, and the problems existed in the practice of land use planning law and their causes are summarized. This chapter is divided into four sections. The first section investigates the general situation of the operation of the land use planning law. The second section concretely analyzes the conflicts in the operation of the legal system of land use planning, including the conflicts between various subjects, the conflicts between various kinds of legal plans and the conflicts after the changes of planning adjustments, etc. The third section synthetically analyzes the conflict of interest in the current land use planning process. The root of the contradiction and conflict lies in the huge value of land use. The current norms of legal system lead to the uneven distribution of land interests and the inability to realize the best state of sharing value-added income. The fourth section studies the types of illegal land use and analysis three typical cases, through the analysis of those cases , the justiciability, illegal relief and other issues during land use planning are discussed. This paper selects three typical cases. The key of the first case is to determine which relative person can be an interested party in the land use planning. The second shows the difference between the land use planning and the overall land use planning. The former is actionable under certain illegal premise while the latter is not actionable because it is not targeted to the majority. The third case further discusses the degree of procedural violation, which will lead to the cancellation and invalidation of the specific planning act, thus giving rise to administrative legal relief.
The fifth chapter gives advice on the improvement of the legal system of land use planning in China. Based on the analysis above, the author puts forward some suggestions and reformative ideas about the legal system of land use planning in China. Although the purpose of land use planning is to promote the public interest, it is still difficult to balance the interests of all parties. In order to deal with the contradictions and conflicts of the various stakeholders mentioned above in the administrative procedure, this paper discusses the relationship between land use planning and social changes, the norms and values of the current legal system of land use planning in China. Based on the investigation of the operation effect of the legal system, four suggestions are put forward to perfect the legal system of land use planning. It includes four aspects: the perfection of legal system, the coordination of conflict, the balance of interests and the legal remedy of land use planning.
