“贷死”作为统治者控制死刑的方法之一，到宋代被制度化并发展到顶峰。本文以宋代存在的大量“贷死”案例为基础，考察宋代“贷死”判决的实施及其适用情况，进而发掘宋代“贷死”频繁出现的原因，并对其进行全面客观的评价。 首先，本文通过梳理“贷死”的起源和发展，从死刑奏裁、“贷死”判决、“贷死”之刑三个方面还原宋代“贷死”判决实施情况。发现宋代绝大部分奏案经皇帝终审被判决贷死，其判决中充分体现了统治阶层意志。被贷者由死刑入生刑，多被杖脊刺配，但在某些特殊群体中亦存在其它处罚方式，由此可见宋代“贷死”之刑在实际的执行中的灵活性。 其次，本文对宋代大量“贷死”判决案例进行梳理、归类，从适用群体与适用案件两方面展现宋代“贷死”判决的适用情况。结合相关案例，对宋代“贷死”的主要群体——官员贵族进行重点剖析，凸显该群体在“贷死”适用上的独特之处。 最后，本文在对“贷死”案件分类梳理的基础上，着重探讨了宋代“贷死”现象的出现原因，得出宋代“贷死”判决之所以盛行，主要是由于统治阶层内的各群体出于利益需要而进行的人为推动。由此，我们可以分析出宋代“贷死”判决的两面性：一方面，其兼顾情理，减死入生，体现宋代统治之仁恕，利于稳固统治；另一方面，其易为人利用，有失公正，滋生犯罪。

The“death penalty’s replacement”is one of the ways to controls the death penalty. Until the Song Dynasty it was institutionalized and developed to the peak. This article is based on a large number of cases of the“death penalty’s replacement”in Song Dynasty,analyses its implementation and application, explores the reasons of its occurrence.Then we should make an overall and objective appraisal of the“death penalty’s replacement”in Song Dynasty. First of all, By reviewing the origin and development, this article focuses on the implementation of the“death penalty’s replacement”in Song Dynasty from three aspects:the review of death penalty,the judgment of the“death penalty’s replacement”,the punishment of the“death penalty’s replacement”. Based on the related materials, most of the death penalty cases involving song emperors were replaced by other penalties.The judgement fully embodies the will of the ruling class.At the beginning of the Song Dynasty,the heavy beat on the back combined with tattoo and banish were used as the punishment for the “death penalty's replacement”, but in actual execution, the penalties were more flexible. Secondly, this article mainly discusses two aspects of the application of the “death penalty's replacement”by sorting and categorizing. In addition, this article focuses on the main group of the “death penalty's replacement”who is bureaucrats or noblemen by combining related cases.The purpose is to show the uniqueness of privileged class. At last, based on the classification for the cases, this article discusses the reasons for the phenomenon of the special judgement in Song Dynasty emphatically.The main reason for the prevalence of the “death penalty's replacement”is the push of the ruling class who intent to protect their own benefits.Thus,we can analyse the two sides of the “death penalty's replacement” in Song Dynasty:On the one hand,it reflects dictator’s benevolence,and contributes to consolidate the feudal rule;On the other hand, it is easy to be taken advantage by some people with ulterior motives, leading to the loses in the justice of the law,giving rise to corruption and crimes.
