生育是国家的百年大计,女性作为生育主体,其传承的重任不容忽视,而就业作为民生之本、立国之基,是女性参与社会生活的基本方式,是获得各种资源的主要途径,其重要地位更不言而喻。但我国生育政策的有利调整无形中加重了女性的负担,加剧了女性就业歧视,而不平等的就业待遇也影响了生育政策的平稳落地。要保证血脉延续,又要保证就业有序,二者的矛盾能否顺利转化,关乎个人的价值追求、社会的和谐稳定和国家的永续发展。因此本论文从生育的角度切入,通过理论与实证的分析,力求探寻保护女性平等就业权的最佳途径。 第一部分,简述本论文的研究背景与意义、研究现状与方法、创新和不足之处。 第二部分,明确生育权、平等就业权的内涵、价值与关系,交代女性生育对国家长远发展的重要性,突出女性平等就业对宏观生育战略预期效果的决定性。 第三部分,结合调研数据、访谈和案例,分析女性生育与平等就业相冲突的现状。女性生育对就业的影响主要表现为就业机会性别歧视,职业性别隔离,就业待遇不平等,再就业歧视等,女性就业对生育的影响主要表现为生育意愿下降,生育水平降低等,此部分能够直观的感受到女性生育与平等就业之间的诸多矛盾与表现。 第四部分,我国在立法上对女性平等就业权的保护虽然取得了一定的进步,人社部等九部门也联合发文促进女性就业,但现行规定还不能完全满足社会发展的需要,依然存在立法理念陈旧,法律规定分散,缺乏专门性、体系性和实操性等不足,在监督执法环节也不具有针对性和强制性,更重要的是缺少程序性的保障和救济机制,导致女性权利救济主观意愿不强,客观程序受阻。 第五部分,多数国家和地区在规制女性不平等就业方面起步较早、发展较为成熟,有大量理论和实践经验,例如加入国际公约、制定专门性、统一性立法,设立专门的监督执法机构,独立行使权力等,还在司法上设置专门法庭和特殊程序为女性提供救济保障,能够为完善我国女性平等就业保护体系提供有益的参考和借鉴。 第六部分,以理论和实证分析为基础,在借鉴和吸收域外宝贵法治经验的同时,结合我国现实情况和发展阶段,构建中国本土化的女性平等就业保护体系,防止女性在就业市场中被边缘化,保护女性的平等就业,提高女性的就业层次、改善女性的就业条件,使女性生育与就业达到平衡和谐的状态。

Fertility is the centennial strategy of the country. As the main body of fertility, women's important task of inheritance cannot be ignored. Employment, as the foundation of people's livelihood and the country, is the basic way for women to participate in social life and the main way to obtain various resources, and its important position is self-evident. However, the favorable adjustment of China's fertility policy has virtually increased the burden on women and aggravated the women's employment discrimination, while the unequal employment treatment has also affected the smooth implementation of the fertility policy. To ensure the continuation of life and orderly employment, the smooth transformation of the contradiction between the two is related to the pursuit of individual value, social harmony and stability and the sustainable development of the country. Therefore, from the perspective of fertility, this paper tries to explore the best way to protect women's equal employment rights through theoretical and practical analysis. The first part briefly describes the research background and significance, research status and methods, innovation and deficiencies of this paper. The second part clarifies the connotation, value and relationship of fertility right and equal employment right, explains the importance of female fertility to the long-term development of the country, and highlights the decisive effect of female equal employment on the macro fertility strategy. The third part, the conflict between female fertility and equal employment is analyzed based on research data, interviews and cases. Female fertility effects on employment mainly for employment gender discrimination, occupational gender segregation, employment treatment inequality, again obtain employment discrimination, etc. The influence of female employment on fertility is mainly reflected in the decrease of fertility willingness and fertility level, etc. This section can be intuitive feel many contradictions between female fertility and equal employment. The fourth part, our country in the legislation on the protection of women's equal employment rights has made certain progress. Nine departments such as Ministry of Human Resources and Social Security of the People's Republic of China also joint mandate to promote women's employment. But the current regulations can't fully meet the needs of social development, here are still outdated legislative concepts, scattered legal provisions, lack of specialization, systematic and operational deficiencies, etc. In the supervision, law enforcement is not targeted and mandatory, more important is the lack of procedural safeguard and the relief mechanism, leading to women's rights relief subjective intention is not strong, objective procedures are impeded. The fifth part, most countries and regions in the aspect of regulating female employment discrimination started earlier, development is relatively mature. There is a lot of theoretical and practical experience, for example, to join the international convention, special formulation, unity of legislation, set up special supervision and law enforcement agencies, independently exercise their power, etc. What's more, set up special courts on judicial remedy protection for women, and special procedures to perfect our country women equal employment protection system to provide beneficial reference. The sixth part, on the basis of theoretical and empirical analysis, in drawing on and assimilating foreign valuable experience under the rule of law, at the same time, combined with China's reality and development stages, building with the localization of Chinese women equal employment security system. To prevent women marginalized in the job market, protect women's equal employment, improve women's employment level, the improvement of women's employment condition, so that women and employment to achieve a balanced and harmonious state.
