近年来,全国各地不断开展农村集体土地流转的试点工作,已经取得了较为丰富的经验,国土资源部也组成调研小组深入各地考察研究,再结合《土地管理法》的修改及十八届三中全会会议精神,在全国范围内进行农村集体土地流转改革已是大势所趋。而我国农村集体土地流转仍处于初级阶段,自发无序的集体土地流转情况大量存在,中国特色国情、未开放的政策及各地的发展差异等因素使集体土地流转改革的开展受到多方制约,难以有序、顺利地进行,成为了当前阻碍农村经济发展、统筹城乡一体化进程的一个热点和难点问题。在此背景下,亟需科学的研究集体土地流转的现状与形势,探索出一套合理完善的集体土地流转改革设想,从而规范流转方式,合理分配流转收益,保障农村经济发展和社会稳定,促进我国构建和谐社会、全面实现小康社会。 本文采用了案例分析的方法,通过对重庆、成都、嘉兴、深圳等有代表性特色的集体土地流转试点案例的深入分析,得出集体土地流转改革有其积极利好的作用,同时也存在着很多的问题和博弈值得研究和探讨,根据对试点案例的思考和分析,笔者认为应该首先进行农村集体建设用地市场的培育,在符合规划的前提下,准许农民通过出租、抵押、转让、入股等模式进行土地流转,在此基础上在进行城乡建设用地市场的初步对接,参考重庆“地票制”模式将集体建设用地指标化,建立统一的土地交易流转市场,最终实现以政府调控为前提、以农地非农化市场交易为基础、以公益性项目征地为补充、以农地非农化外部性补偿为延伸的城乡统一的建设用地市场。

In recent years, the development of rural collective land transfer pilot work, has achieved a more extensive experience, the Ministry of land and resources also formed a research group in-depth study, combined with the reform of land management law and the spirit of the Third Plenary Session of the eighteen, in the national scope of rural collective land transfer reform is the trend. The rural collective land transfer is still in the primary stage, the characteristics of China's national conditions, the unopen policy and the different development of areas, such as the development of land transfer reform is subject to various constraints, it is difficult to orderly and smoothly, has become a hot and difficult problem in the process of rural economic development, urban and rural integration. Under this background, it is urgent to study the current situation and situation of collective land transfer, explore a set of reasonable and perfect idea of collective land transfer, so as to regulate the transfer mode, transfer income reasonably, ensure the rural economic development and social stability, and promote the construction of harmonious society and the well-off society in China.This paper uses the method of case analysis, through in-depth analysis of the collective land circulation pilot case representative characteristics of Chongqing, Chengdu, Jiaxing, Shenzhen, the collective land circulation reform has its positive effect, there are also many problems to study and explore, and according to the thinking and analysis of the pilot the case, the author thinks that we should first cultivate the rural collective construction land market, in line with the planning under the premise, allow farmers through rental, mortgage, transfer of shares, and other modes of land circulation, on the basis of the urban and rural construction with the initial docking market, Chongqing "land ticket system" mode collective construction land, the establishment of land circulation market transactions unified, and ultimately to the government regulation as the premise, based on market transaction, farmland conversion by land expropriation of farmland conversion, with external compensation for the extension of the unified urban and rural construction land market.
