20世纪80年代,我国改变传统的计划经济体制为社会主义市场经济体制,随之而来的是住房制度改革,物业管理难题逐渐成为基层治理的主要矛盾。社区党组织与居委会、业主委员会、物业公司是一个结构健全的小区的基本组织。由于业主委员会成立难度大、比例低,2020年5月1日,北京市出台了《北京市物业管理条例》,提出在北京市成立物业管理委员会(以下简称物管会)。在物业管理纳入社区治理的视角下,作为一种新生的社区自治组织,物管会背后的运行机制和作用机制是值得深入研究。

本研究从国家-市场-社会的三维框架出发,以治理理论、社区治理理论、合作治理理论为基础,将小区物业管理纳入社区治理体系之中,在呈现基层治理实践中物管会组织样态的基础之上,通过分析小区典型事件,从参与路径、参与特征、参与机理三个方面,探究物管会参与社区治理的模式和机制,并考察物管会参与社区治理的效果。研究发现,物管会是住宅小区的新型治理主体,具有协调性、过渡性、公益性、局限性。物管会的加入,使小区形成多元主体参与的稳定三角治理结构,物管会代表居民参与小区治理。物管会在社区党组织与居委会、物业公司、居民之间建立起联动机制,如传达与沟通机制,协商与决策机制,监督与制衡机制。政府为物管会建设与运作提供要素支持,在个体与公共组织间建立制度化联系。物管会连接物业公司与居民,搭建“维权+自治”平台,构建起居民自治通道。

合作治理是新时代社区治理的新路径,呈现出权力主体多元化、权力关系多样化、权力运作互动化的特点。国家积极支持和引导物管会承接政府服务,通过自上而下的科层制实现资源分配,维护资源分配的公平性,通过兜底物业服务,弥补市场失灵的负面影响。物业公司提供市场化服务,有效借助市场交换机制、竞争机制引入市场资源,提升政府服务的效率。物管会汇集居民掌握的社会资源,组织集体决策,推动社区公共事务的民主化表决。物管会通过与其他治理主体互动,构建起国家、市场、社会之间的合作关系,推动城市社区治理结构完善,转变基层治理方式。

物管会参与社区治理取得一定成效,体现为民主决策公共事务,提升基层治理效率;监督协调物业工作,提升物业管理水平;有效化解社会矛盾,扩大居民自治参与。作为新兴组织,其在运行机制和作用发挥方面存在困境,表现为居民自治意识薄弱,向业委会转化难度大;小区治理资源匮乏,物管会发挥作用受限;居委会行政化严重,消极推进物管会建设。本文认为,应强化物管会治理主体地位,配备多样化资源;培养居民自治观念,构建社区共同体;完善顶层设计,加强培训和指导。如此,才能让物管会真正发挥治理效能,实现共建共治共享的目标。

In the 1980s, China changed its traditional planned economic system into a socialist market economic system, which was followed by the reform of the housing system. Property management problems have become the main contradiction in grassroots governance. Community Party organizations, neighborhood committees, owners' committees, and property companies are the basic organizations of a well structured community. Due to the difficulty and low proportion of establishing an owner's committee, on May 1, 2020, Beijing issued the "Beijing Property Management Regulations", proposing to establish a property management committee (hereinafter referred to as the Property Management Committee) in Beijing. From the perspective of incorporating property management into community governance, as a newly emerging community autonomous organization, the operating mechanism and functional mechanism behind property management committees are issues worthy of in-depth study.

This study starts from the three-dimensional framework of the state, market, and society, and is based on governance theory, community governance theory, and cooperative governance theory. It integrates community property management into the community governance system. On the basis of presenting the organizational patterns of property management committees in grassroots governance practices, it explores the modes and mechanisms of property management committees participating in community governance through analyzing typical community events from three aspects: participation path, participation characteristics, and participation mechanism.

And investigate the effect of the property management committee's participation in Community Governance. The study found that the property management committee is a new type of governance body for residential communities, with coordination, transition, public welfare, and limitations. The addition of the Property Management Committee has led to the formation of a stable triangular governance structure involving multiple entities in the community. The Property Management Committee represents residents in the community governance. The Property Management Committee has established linkage mechanisms between community party organizations, neighborhood committees, property management companies, and residents, such as transmission and communication mechanism, negotiation and decision-making mechanisms, and supervision and balance mechanisms. The government provides essential support for the construction and operation of the Property Management Commission, establishing institutionalized connections between individuals and public organizations. The Property Management Commission connects property management companies and residents, builds a "rights protection+autonomy" platform, and constructs a resident autonomy channel.

Cooperative governance is a new approach to community governance in the new era, characterized by the diversification of power subjects, the diversification of power relations, and the interaction of power operation methods. The state actively supports and guides the Property Management Commission to undertake government services, achieve resource allocation through a top-down bureaucratic system, maintain fairness in resource allocation, and compensate for the negative impact of market failure by providing property services. Property companies provide market-oriented services, effectively introducing market resources through market exchange mechanisms and competition mechanisms, and improving the efficiency of government services. The Property Management Committee collects social resources held by residents, organizes collective decision-making, and promotes democratic voting on community public affairs. By interacting with other governance entities, the Property Management Commission has established a cooperative relationship between the state, market, and society, promoting the improvement of urban community governance structures, and transforming grassroots governance methods.

The participation of the Property Management Committee in community governance has achieved significant results, reflected in democratic decision-making of public affairs and improving the efficiency of grassroots governance; Supervise and coordinate property management work to improve the level of property management; Effectively resolve social conflicts and expand residents' participation in self-government. As a new thing, there are difficulties in its operational mechanism and role play, manifested in the weak awareness of residents' autonomy and the difficulty of transforming to industry committees;Community governance resources are scarce, and the role of property management committee is limited; The neighborhood committee has been heavily administrated and has been negatively promoting the construction of property management committees. This article believes that the property management committee should strengthen its dominant position in governance and allocate diverse resources; Cultivate the concept of residents' autonomy and build a community; Improve top-level design, strengthen training and guidance. In this way, let the property management committee truly exert its governance effectiveness and achieve the goal of joint construction, governance, and sharing.
