Digital technology has advantages such as high efficiency, unified law enforcement standards, and low labor costs. It is increasingly widely used in the field of administrative discretion, and can create online processes, save electronic forms of evidence, and set standards for discretion, playing an auxiliary role. The application of digital technology in the field of administrative discretion has overturned the carrier and led to disagreements in judicial practice regarding its status. The secrecy of technology can easily impact the legitimate rights and interests of administrative counterparts, and may cause laziness among administrative subjects, thereby affecting the legitimacy of discretionary decisions. Legislation should clearly regulate the application of digital technology in the field of administrative discretion, and utilize the principle of due process to promote the updating of digital technology. On the other hand, it is necessary to implement the main responsibility of administrative agencies in using digital technology, and establish a supervision mechanism for deviation warning. Through internal and external means, the application methods of digital technology in the field of administrative discretion should be explored in the balance of legality and efficiency. |
