近年来，恶性交通肇事案件的频发，使得道路交通安全问题已成为社会公众关注的热点问题。个别交通肇事案件由于其在司法实务及社会反应方面所体现出的特点，使得其成为民众所普遍关注的公共法律事件，并引发了我国理论界和实务界对恶性交通肇事案件的定罪与量刑等一系列问题的探讨。本文以胡斌交通肇事案为例，运用刑法原理分析交通肇事罪的相关问题。即界定交通肇事罪与以危险方法危害公共安全罪之间的联系与区别；自首在交通肇事类案件中的认定；从本案的民事赔偿问题引起的争论入手，分析民事赔偿对于交通肇事案件定罪量刑的作用和影响；综合本案定罪、犯罪情节、民事赔偿等问题探讨交通肇事罪的量刑问题；找出目前我国刑事立法中关于交通肇事罪相关规定的不足之处，并对可以改进的地方提出意见和建议，给出合理的解决方案。

The frequent occurrence of traffic accidents with heavy casualties in recent years has drawn the public’s extensive attention. Some traffic accident crime cases have become widespread public legal events of greater public concern, and led to deep theoretical and practical discussions on the issues of conviction and sentencing of such crime cases, due to their characteristics reflected on judicial practice and social reactions,This paper used Hu Bin Traffic Accident as an example to discuss the use of criminal law principles on traffic accident crime related issues. That is, this paper is intended to define the relationships and differences between traffic crime and the crime of endangering public safety; to define surrendered problem associated with traffic accident cases; to analyze the role and influence of civil compensation on traffic accident crime conviction and sentencing, from the debates on civil compensation arising from the current case; to summarize the conviction of the case, specific circumstances of the crime, civil compensation and other related issues to further discuss the crime sentencing associated with traffic accident crime; to find out inadequacies existing in our current criminal legislation provisions for the traffic accident crime, and to make suggestions and recommendations on certain identified areas for improvement, to further provide reasonable solutions.
