数字时代呼唤数字货币。如今,法定数字货币已经启动了国内的流通场景,跨境的流通场景也迈入试点阶段。法定数字货币的跨境流通对于维护国家货币主权、保障货币政策独立性、防范金融风险等方面具有重要意义。法律制度是法定数字货币起步的必备条件，也是法定数字货币实现跨境流通的制度保障。现有的法学研究呈现出“碎片化”的研究现状；针对法定数字货币跨境流通的研究存在诸多理论空白。面对法定数字货币跨境流通的蓄势待发之势,需要通过现有对法律属性的研究成果,对法定数字货币跨境流通问题展开研析,从而为法定数字货币跨境流通的风险防范、国际合作提供理论参考。

本文聚焦法定数字货币跨境流通的梗阻，以“分析问题--解决问题”为目的,围绕我国法定数字货币跨境流通的法律问题进行探讨。本文从对法定数字货币概念及跨境流通路径的界定出发，厘清法定数字货币跨境流通研究的基本范畴；在此基础上，本文通过分析我国法定数字货币跨境流通面临的现实难题，展现了我国法定数字货币在实现安全高效跨境流通中存在的法律障碍以及实现跨境流通后可能面临的法律风险。结合现有邓巴项目、多边数字货币桥项目中的国际风险治理经验，对法定数字货币跨境中面临的货币主权、数据隐私安全以及协同监管等问题总结了可能路径；最后，基于前文的法律问题分析和国际风险治理经验借鉴，本文认为我国法定数字货币跨境流通其中涉及的法律问题既具有国内性，也具有涉外性，既需要国内法律制度的完善，也需要国际法律规则的协调。此外，由于法定数字货币跨境流通是一个动态发展的过程，需要以包容性的法治理念持续关注法定数字货币跨境流通的发展趋势，及时调整和完善法律规制策略。因此，本文从国内法治与涉外法治两个层面提出应对建议，提倡构建包容性的法定数字货币跨境法律体系，以期为我国法定数字货币跨境流通法律问题的解决提供参考。

The Digital Era Calls for Digital Currency. Today, legal digital currency has initiated domestic cross-border circulation scenarios, with cross-border circulation scenarios also entering the pilot phase. Especially in the digital age, the cross-border circulation of legal digital currency holds significant importance in safeguarding national currency sovereignty, ensuring monetary policy independence, preventing financial risks, and protecting data privacy and information security. In the face of the burgeoning momentum of cross-border circulation of legal digital currency, it is advisable to draw upon existing research findings on risks and their governance measures, comprehensively analyze the risks of cross-border circulation of legal digital currency, and thus provide theoretical references for risk prevention and international cooperation in the cross-border circulation of legal digital currency.

This paper focuses on the obstacles to the cross-border circulation of legal digital currencies, with the aim of “analyzing problems and solving problems,” focusing on the legal issues of the cross-border circulation of legal digital currencies in China. Starting from the definition of legal digital currency and cross-border circulation paths, this paper clarifies the basic categories of research on the cross-border circulation of legal digital currencies. Based on this foundation, the paper analyzes the practical difficulties faced by China’s legal digital currency in cross-border circulation, revealing the legal obstacles to achieving safe and efficient cross-border circulation and the legal risks that may arise after cross-border circulation. Combining international risk governance experience from existing projects such as the Dunba project and m-bridge projects, possible pathways for addressing issues such as currency sovereignty, data privacy security, and collaborative regulation in the cross-border circulation of legal digital currencies are summarized. Finally, based on the analysis of legal issues and international risk governance experience, it is argued that the legal issues involved in the cross-border circulation of legal digital currencies in China are both domestic and international, requiring both domestic legal system improvements and international legal rule coordination. Furthermore, as cross-border circulation of legal digital currencies is a dynamic process, it is necessary to continuously monitor the development trends of cross-border circulation with an inclusive rule of law concept and adjust and improve legal regulatory strategies in a timely manner. Therefore, this paper proposes response suggestions from both domestic and international legal governance perspectives, advocating for the construction of an inclusive legal framework for the cross-border circulation of legal digital currencies, aiming to provide references for solving legal issues related to the cross-border circulation of legal digital currencies in China.
