作为新兴产业，剧本杀在飞速发展的同时，产生了诸多著作权侵权法律风险。通过梳理剧本杀行业线上发展现状及问题，分析剧本杀的作品属性和侵权内容，并运用“思想/表达二分法”和合理使用规则对权利边界进行厘清。同时，结合互联网相关的著作权法治实践，对剧本杀著作权保护机制进行设想，以第三方平台为核心，明确“通知+必要措施”原则，并进一步引入自动内容识别机制和维护著作权法合理使用制度的算法措施，以期为剧本杀乃至其他新业态的著作权线上保护提供规则指引和实践路径。
