作为极端的人际暴力,亲密伴侣杀人受到联合国等国际组织的高度重视,从而将其作为性别暴力和人权问题的一部分进行研究。针对这一暴力犯罪,已有研究就犯罪的社会经济背景、心理动机、犯罪人和被害人特征等方面进行了深入的探讨。与此相对,中国的相关研究则集中于家庭暴力层面,对于亲密伴侣杀人犯罪的研究处于起步阶段,但已经有一些重要研究成果。如学者赵书鸿研究发现,中国亲密伴侣杀人多发生在社会经济地位较低的人群中,大多数被害人都是女性。同时,他的研究还进一步揭示了犯罪人与被害人之间的亲密关系在理解这类致命性人际暴力中的重要性。本研究正是在此基础上,以中国亲密伴侣杀人犯罪中的“关系破裂”为切入点,意图深入理解这类犯罪现象的发生原因。对此,通过对中国822件亲密伴侣杀人案件进行分析,发现了不同犯罪人性别、关系地位和关系持续时间的案件中“关系破裂”原因存在明显差异性。

研究结果发现:当犯罪人为男性时,无论关系地位如何、关系持续时间多久,“琐事争吵”是造成“关系破裂”的首要原因。双方为配偶关系时,“出轨”这一原因占比较高,且关系持续时间越长,因“出轨”而“关系破裂”的可能性越大。在恋人这种亲密关系中,“财产处分”是较为明显的原因。在亲密关系持续时间10年以上的伴侣中,因“琐事争吵”更容易引起“关系破裂”。当犯罪人为女性时,“琐事争吵”仍然是首要的“关系破裂”原因。但在现任配偶关系中,“伴侣暴力”这一原因表现得较为明显。在10年以上的亲密关系中,“伴侣暴力”是一个非常突出的“关系破裂”原因。以上实证发现能够帮助更清晰地理解中国亲密伴侣杀人的实际情况,如“琐事争吵”这一原因反应了伴侣间的沟通问题,这些情况可为预防这一致命性人际暴力犯罪提供一定的实证发现依据。

根据实证发现,本研究结合中国实际情况和相关理论,尝试对亲密伴侣杀人犯罪中“关系破裂”原因进行深入探讨。对于犯罪人为男性时,“出轨”这一原因占比较高,运用了女性主义理论和传统文化帮助解释。对于犯罪人为女性时的“伴侣暴力”原因,结合了儒家重视家族稳定等方面去理解。对于“琐事争吵”这一原因,则考虑了沟通方式。而“财产处分”则结合社会发展背景做出了解释。最后,根据讨论结果,提出了三点预防措施,希望更早一步对这类犯罪做出预防。

As an extreme form of interpersonal violence, intimate partner homicide has received high attention from international organizations such as the United Nations, which has thus studied it as part of gender-based violence and human rights issues. In response to this violent crime, studies have been conducted on the socioeconomic background of crime, psychological motivations, and characteristics of perpetrators and victims. In contrast, relevant research in China focuses on domestic violence. The research on intimate partner homicide is in its infancy, but there have been some important research results. For example, the research of scholar Zhao Shuhong found that intimate partner homicide in China mostly occurred in people with low socioeconomic status, and most of the victims were women. At the same time, his research further revealed the importance of the intimate relationship between the perpetrator and the victim in understanding this type of deadly interpersonal violence. On this basis, this study takes the “relationship breakdown” in China’s intimate partner homicide crime as an entry point, and intends to deeply understand the causes of this kind of crime. In this regard, through the analysis of 822 intimate partner homicide cases in China, it is found that there were obvious differences in the causes of “relationship breakdown” in cases with different criminal gender, relationship status and relationship duration.

The study found that when the perpetrator was a man, “trivia quarrels” was the leading cause of “relationship breakdown” regardless of relationship status or duration. When the two were spouses, “having an affair” was a higher cause of “relationship breakdown”, and the longer the relationship lasted, the more obvious this reason became. In romantic relationships, “property disposition” was a more obvious reason. Couples who have been in close relationships for more than 10 years were more likely to break up over “trivia quarrels”. When the perpetrator was a woman, “trivia quarrels” remained the top “relationship breakdown” cause. However, in the current relationship, the cause of “partner violence” was more obvious. In intimate relationships over 10 years, “partner violence” was a very prominent cause of “relationship breakdown”. The above empirical findings can help to understand the actual situation of intimate partner homicide in China more clearly. For example, the reason of “trivia quarrels” reflects the communication problems between partners, and these circumstances can provide certain empirical findings for the prevention of this fatal interpersonal violence crime.

Based on empirical findings, this study combines the actual conditions in China with relevant theories to conduct an in-depth exploration of the causes of “relationship breakdown” in crimes of intimate partner homicide in China. When the perpetrator is male, “having an affair” accounts for a relatively high proportion, and feminist theory and traditional culture are used to help explain this. In cases where the perpetrator is female and the cause is “partner violence”, the tolerance of women is understood in conjunction with aspects such as the Confucian emphasis on family stability. For the primary cause of “trivia quarrels”, the way of communication has been considered. And “property disposition” has been explained in the context of social development background. Finally, based on the discussion results, three preventative measures are proposed, in the hopes that such study can help prevent this type of crime at an earlier stage.
