随着我国进入大数据时代,特别是移动互联网的快速发展,我们的日常生活愈发便捷化、智能化。传统的时空限制在大数据时代被打破,我们的娱乐活动也更加丰富多彩。越来越多的商业服务和政务服务开始电子化、云端化,我们可以足不出户的在手机上办理各
项业务,例如网上购物、充值取暖费、办理社保等。但我们也要看到,在享受数字平台带来便利服务的同时,我们也“支付”了个人数据并留下了大量使用痕迹。我们的数据隐私构成了数字平台日常运作的关键“原料”,对于用户数据隐私的挖掘和利用,也越来越成为企业在商业竞争中的重要优势。特别是随着数据驱动型并购的快速发展,数据集中所带来的平台企业的市场力量,也在急速增加,出现了过度收集和滥用用户信息,侵犯消费者利益等需要反垄断法规制的反竞争行为。数据隐私与反垄断法这两个看似泾渭分明的领域,在大数据时代出现了交叉。
在第一章和第二章中,阐述本文选题背景和国内外研究现状,界定数据隐私的概念,梳理近年来欧美竞争主管机关介入,数据隐私保护的典型案例,并总结域外实践经验,提出数据隐私纳入反垄断法规制的时代属性。
第三章主要阐述将数据隐私纳入反垄断法分析框架。首先分析反垄断法介入数据隐私的理论争议,从数据隐私作为一种重要的非价格竞争维度、消费者利益的组成部分和市场进入壁垒等方面,论证支持数据隐私纳入反垄断法规制的理论可行性。也结合分析部分学者主张的垄断法规制可能存在的障碍,即数据隐私保护不符合反垄断法的目的、隐私悖论和个人数据难以量化保护的问题。然后论证对数据隐私进行反垄断法规制的必要性:当前市场竞争受到限制不利于保护数据隐私,数据隐私保护符合反垄断法立法宗旨,反垄断法
规制数据隐私的优势,其他法律保护方面的不足。
第四章主要分析我国反垄断法规制数据隐私存在的路径,以及规制的具体场景。分析数字时代消费者利益和产品质量的内涵,阐述数据隐私纳入不同路径的理由。
第五章,提出应当将数据隐私保护全面纳入反垄断法分析框架,结合不同的场景选择合适的保护路径,同时要注意和其他法律的分工和协作。

As my country has entered the era of big data, especially the rapid development of mobile Internet, our daily life has become more convenient and intelligent under the empowerment of technology. The traditional time and space constraints are broken in the era of big data, and the entertainment activities we enjoy are greatly enriched. More and more commercial services and government services are becoming electronic and cloud-based, and we can handle various businesses on our mobile phones without leaving home. But we must also see that while enjoying the convenience of digital platforms, we also "pay" for a large amount of personal data and leave traces of usage. Our data privacy increasingly constitutes the "raw material" for the operation of digital platforms, and the degree of mining and utilization of user data privacy has increasingly become an important advantage for enterprises in business competition. Especially with the rapid development of data-driven mergers and acquisitions, the market power of platform-based enterprises brought about by data collection has increased rapidly, and there have been anticompetitive behaviors that need to be regulated by anti-monopoly laws, such as excessive collection and abuse of user information, and infringement of consumer interests. Data privacy and antitrust law, two seemingly distinct fields, intersect in the era of big data. In the first and second chapters, the background of this paper and the research status at home and abroad are mainly expounded. This paper expounds the concept of data privacy, sorts out the typical cases of European and American competition authorities involved in data privacy protection in recent years, summarizes the practical experience outside the territory, and proposes that data privacy should be included in the era of anti-monopoly laws and regulations. The third chapter mainly analyzes the anti-monopoly law that incorporates data privacy into the analysis framework of anti-monopoly law. Firstly, analyze the theoretical controversy about the involvement of anti-monopoly law in data privacy, and demonstrate the feasibility of supporting the inclusion of data privacy into anti-monopoly law from the perspectives of data privacy as an important dimension of non-price competition, a component of consumer interests, and market entry barriers. sex. It also discusses the possible obstacles to direct regulation of anti-monopoly law on the issues of data privacy and the direct purpose of anti-monopoly law, the paradox of privacy and the difficulty of quantifying the protection of personal data. Then conduct an analysis of the necessity of antitrust laws to regulate data privacy. It is discussed from four perspectives: firstly, it is discussed that the current market competition is restricted to protect data privacy; secondly, it is analyzed that data privacy protection conforms to the legislative purpose of anti-monopoly law; finally, it is analyzed that the advantages of anti-monopoly law in regulating data privacy and other deficiencies in legal protection. The fourth chapter analysis mainly analyzes the path choice of my country's anti-monopoly law to regulate data privacy, and the specific scenarios of regulation. Analyze the connotation of consumer interests and product quality in the digital age, and explain the reasons for incorporating data privacy into different paths. Finally, it is proposed that data privacy protection should be fully incorporated into the analysis framework of anti-monopoly law, and appropriate protection paths should be selected in combination with different scenarios, and attention should be paid to the division of labor and writing with other laws.
