非法集资类犯罪案件呈现出作案手段现代化、新颖性等特征,涉案金额巨大、被害人数众多,危害国家金融安全和社会秩序。在非法集资案件处置过程中存在着集资组织者与集资参与人责任划分不明晰、行政处置与司法裁判衔接不畅等问题,实践中存在政府为集资参与人过错买单的情形,这些问题都暴露出非法集资处置存在疏漏。2017年8月24日,国务院法制办就《处置非法集资条例(征求意见稿)》(以下简称“征求意见稿”)公开征求意见,完善了处置流程和责任分配,征求意见稿第四条明确提出,非法集资参与人应当自行承担因参与非法集资受到的损失。(本条例所称非法集资参与人,是指为非法集资投入资金的单位和个人)。为非法集资参与者敲响了警钟,也为各级负责处置非法集资案件的政府部门明确了清退范围和职责。
本文围绕非法集资案件处置暴露出的问题进行论述,共分为三章,第一章通过三个维度论述了非法集资相关理论背景,一是非法集资犯罪概念的发展脉络,二是我国非法集资刑事政策的发展,三是非法集资犯罪成灾的金融背景。第二章阐述了我国非法集资参与人“自担损失”理念的产生发展以及落实困难的原因。第三章结合《处置非法集资条例(征求意见稿)》提出“自担损失”制度的落实的对策,包括完善非法集资各方主体间责任分配与衔接,借鉴民事“被害人过错”归责原则划分集资参与人责任,落实行政处置与司法裁判的衔接等。最后总结上述内容,提出通过严格规范非法集资案件处置流程、培育非法集资参与人“自担损失”意识、加强对各级党政干部参与非法集资犯罪惩处力度等主客观方面共同促进集资参与人自担风险的落实,希望较为全面的论述,厘清落实集资参与人自担风险制度的思路。

The criminal cases of illegal fund-raising show characteristics such as the modernity and novelty of the means of committing the crime. The amount involved is huge and the number of victims is numerous, which endangers the national financial security and social order. In the process of disposing of illegal fund-raising cases, there are problems such as the unclear division of responsibilities between fund-raising organizers and fund-raising participants, poor connection between administrative disposition and judicial judgment, etc. In practice, there are cases where the government pays for fund-raising participants and these problems are revealed. There are omissions in illegal fund raising and disposal. On August 24, 2017, the Legal Affairs Office of the State Council publicly solicited opinions on the Regulations on Disposal of Illegal Fund Raising (Draft for Soliciting Opinions) (hereinafter referred to as the “Draft for Soliciting Opinions”), and improved the disposal process and distribution of responsibilities. It is proposed that illegal fund-raising participants should bear the losses incurred as a result of participating in illegal fund-raising. (Illegal fund-raising participants referred to in these Regulations refer to units and individuals who invest funds for illegal fund-raising). It also sounded alarm bells for illegal fund-raising participants and clearly defined the scope and responsibilities of the government departments responsible for disposing of illegal fund-raising cases at all levels.
This article discusses the issues exposed in the handling of illegal fund-raising cases. It is divided into three chapters. The first chapter discusses the theoretical background of illegal fund-raising through three dimensions. First, the development of the concept of illegal fund-raising crimes; second, criminalization of illegal fund-raising in China. The development of policies is the financial background of illegal fund-raising crimes. The second chapter elaborates the origin and development of the concept of self-owned loss of the illegal fund-raising participants in our country and the reasons for their implementation difficulties. The third chapter combines the "Illegal Fundraising Regulations (Draft for Soliciting Opinions)" to put forward measures for the implementation of the "self-paid loss" system, including improving the distribution and linking of responsibilities among the parties involved in illegal fund-raising, and drawing on the principle of the civil "victim's fault" Recruitment of fund-raising participants, implementation of administrative procedures and judicial adjudication, etc. Finally, summarizing the above-mentioned contents and proposing to promote fund-raising participants from the subjective and objective aspects such as strictly stipulating the process of handling illegal fund-raising cases, cultivating the awareness of self-inflicted losses of illegal fund-raising participants, and strengthening the punishment of party and government cadres at all levels in participating in illegal fund-raising crimes. The implementation of risk-taking, I hope that a more comprehensive discussion, to clarify the implementation of risk-raising participants own risk system of ideas.
