随着我国改革开放政策的实施,土地私有化和市场化进程加速。房产中介行业从无到有获得了长足的发展。房地产中介行业在市场主体的需求方和供给方之间,居间提供便捷的服务平台,为双方通报信息、提供居间服务,形成交易纽带。同时,房地产中介行业在促进房地产市场流通也存在着各类违法违规行为。这类行为对交易双方合法权益造成侵害,损害国家利益,破坏经济秩序。房产中介行业违法违规问题产生的主要原因是中介行业定位不明确,三方信息不对称,政府介入机制不完善等方面。我国学者从不同角度对房产中介行业的违法违规问题进行研究并提出规范行业发展的可行性建议,为我国房产中介行业的发展提供了宝贵的意见和建议。 
本文通过对房产中介行业的违法违规案例分析,查找房产中介行业违法违规行为的根本原因,追溯房产中介行业产生的背景,探究房产中介行业存在的必要性,进而确定我国房产中介行业的定位及服务范围,畅想我国房产中介行业未来发展前景及发展模式,论证政府主导房产中介行业的可行性及可操作性,为房产中介行业规范化发展提出个人的建议。 
第一部分,通过对我国房地产中介的发展历史进行探讨和研究。从理论和实际的角度,通过房产中介行业发展的历史确定了其产生的必然性和存在的必要性,对现阶段房产中介行业发展面临的问题进行概括分析。 
第二部分,通过案例分析研究我国房产中介行业的违法违规行为,对当前主要面临的几类房产中介行业违法违规行为所涉及的罪名及法律规范进行归类,阐述了各类房产中介行业违法违规行为造成的社会影响和不法后果,并对其中所涉及的根本原因作了详细的阐述。
第三部分,从现实角度分析房产中介行业违法违规问题的背景和产生的原因。在我国房产中介行业发展过程中存在断层,重新起步后受资本市场影响发展迅速但行业定位不明确,市场信息不对称,政府介入不深入,行政立法不完善,行政监管不到位,行政处罚不严厉,行政救济不健全。 
第四部分,提出房产中介行业发展的规范化建议。在以政府有力的介入下,明确房产中介行业定位,保障信息公开,完善行政立法,加强行政监管,健全行政处罚和救济制度,探讨政府主导房产中介行为的可行性,成立官办信息平台,强制交易备案制度,严格资金监管。
 

外文摘要:

With the gradual improvement of China's market economy construction and the adjustment of national industrial policies, the real estate intermediary industry has developed rapidly from scratch in the real estate intermediary industry. The real estate intermediary industry provides a convenient information platform between the demand side and the supply side of market entities, informing the public of information, providing media services, and forming an information link. In the real estate intermediary industry, while promoting the circulation of the real estate market, there are also various violations of laws and regulations that infringe upon the legitimate rights and interests of both parties, harm national interests, and disrupt the order of the market economy. The main reasons for the lagging and chaotic development of China's real estate intermediary market are unclear positioning of the intermediary industry, asymmetric information, and imperfect government intervention. Scholars from various disciplines have conducted research on real estate intermediaries from different perspectives, and a number of outstanding achievements have been published, providing a theoretical basis for the development of real estate intermediaries in China.
By enumerating the prominent illegal and illegal phenomena existing in the real estate intermediary industry, this article explores the fundamental reasons for the illegal and illegal operations of real estate intermediary agencies, sorts out the legal relationships between various parties in intermediary activities, deeply studies the background of various illegal behaviors, and puts forward several suggestions on the construction of the regulatory system for the real estate intermediary industry in China. I hope to do my bit to contribute to the improvement of the normative construction of real estate intermediaries in China through my own discussion and analysis of relevant issues.
The first part briefly describes the historical development process of real estate intermediaries in China. This paper expounds the inevitability and necessity of the emergence of real estate intermediary services in China from both theoretical and practical perspectives, and briefly describes the problems faced by the development of the real estate intermediary industry at this stage.
The second part proposes the actual illegal and illegal behaviors in China's real estate market, analyzes the various illegal and illegal behaviors that damage the legitimate rights and interests of the parties and the legal norms involved, briefly describes the social harm caused by various illegal and illegal behaviors, and expounds in detail the fundamental reasons involved.
The third part analyzes the background and reasons of violations of laws and regulations in the real estate intermediary industry from a practical perspective. There are faults in the development of China's real estate intermediary industry. After restarting, it has developed rapidly under the influence of the capital market, but the industry positioning is unclear, market information is asymmetric, and government intervention is not in-depth.
The fourth part proposes standardized suggestions for the development of the real estate intermediary industry. With the strong intervention of the government, clarify the positioning of the real estate intermediary industry, ensure information disclosure, improve administrative legislation, strengthen administrative supervision, improve the administrative penalty and relief system, and explore the feasibility study of government leading real estate intermediary behavior.
