改革开放四十年来，中国对环境经历了从“先污染，后治理”到“绿水青山就是金山银山”这样的观念转变。从生态环境治理到居住环境治理，居民的生活垃圾问题无疑是改善居住环境首先要解决的问题。如今城市已经摸索出一套较为成熟的城市生活垃圾分类治理模式，然而，大部分的农村地区生活垃圾分类处理模式还处于起步阶段。本文在总结当前立法执法的现状基础上，针对农村生活垃圾分类处理提出一些可行的法律建议。在总结当前的研究现状的基础上，发现国内研究主要集中在法理、分类模式、技术支撑的方面，主要针对中央一级的立法、政府责任、公众参与等方面提出建议。而本文主要针对地方立法提出立法建议。本文第一章为当前我国农村生活垃圾污染现状和分类现状的概述，之后总结当前国内立法现状，指出当前立法的不足，并提出相应的建议，包括细化规定、制定强制垃圾分类条款、明确政府、企业、村民责任和建立一套监管体系等。同时在最后一章对农村垃圾分类提出一些可行的建议。

In the past 40 years of reform and opening up, China has experienced a conceptual shift from “first pollution, then governance” to “green water and green mountains are mountains of gold and mountains of sliver”. From ecological environment management to residential environment management, the problem of residents' domestic garbage is undoubtedly the first problem to be solved in improving the living environment. Nowadays, the city has explored a relatively mature urban domestic waste classification and treatment model, but most rural areas have not yet developed and improved the classification and treatment mode of rural domestic waste. This essay mainly proposes the classification of rural domestic waste from the legal point of view. Firstly, the first chapter defines the current situation of rural domestic garbage pollution, and finds that the current environmental pollution of rural domestic garbage has not been well resolved. Then summarizing the current research status, it is found that domestic research mainly focuses on jurisprudence, classification model and technical support, and mainly proposes suggestions on the central level of legislation, government responsibility, and public participation. This article mainly proposes legislative proposals for local legislation. After summarizing the current status of domestic legislation, pointing out the shortcomings of the current legislation and then put forward corresponding recommendations. This includes refining regulations, formulating mandatory waste classification clauses, clarifying government, enterprises, villager responsibilities, and establishing a regulatory system.
