商标侵权是最常见的侵权假冒表现形式之一。商标侵权作为一种“搭便车”的不正当竞争行为,侵犯了商标权人的私权利,破坏了公平竞争的市场秩序,与此同时,商标侵权行为混淆商品来源,误导欺骗消费者,侵犯了消费者合法权益,损害了市场消费环境。把商标侵权治理职能赋予工商行政管理部门,对于解决商标侵权涉及的社会公共利益,具有重大意义。 工商行政管理部门虽然在治理商标侵权方面积累了丰富的经验,取得了显著的成果,但现阶段正面临着诸多新形势、新要求、新挑战。能否有效治理商标侵权,不仅关系到国家的竞争力和国际形象,关系到经济转型升级和民生改善,也关系到工商市场监管制度改革的成败。因此,结合治理形势、治理需求对当前的治理困境和原因进行剖析,进而提出行之有效的解决对策对于推动和改善商标侵权治理具有一定的理论价值和现实意义。截至目前,从公共管理角度对工商行政管理部门开展商标侵权治理进行研究的成果比较少见。 本文从政府市场监管相关理论入手,结合当前面临的各种新形势与新困难,从治理观念、治理体制、治理方式、治理对象、治理主体等五个层面,围绕工商行政管理部门商标侵权治理职能的实现与改善进行了研究,提出了重新审视行政治理优势、改善行政治理资源布局、加快适应体制转变步伐、布局机构调整顶层设计、构建信用公示体系、合理运用信用监管、加强网络交易平台治理、提高“以网管网”能力、建立以工商部门为主导的多元主体互动的治理工作机制、促进社会共治等建设性意见。

Trademark infringement is one of the most frequent forms of infringement and counterfeiting behavior. As a kind of “free-riding” illegitimate competitive behaviors, trademark infringement violates trademark owner’s interests and breaks the market order of fair competition. At the same time, the trademark infringement behavior mixes the commodity source,misleads consumers, infringes the legal rights of consumers as well as contaminates the market consumption environment. To endow the administration for industry and commerce with the authority on trademark infringement governance plays an important role to address trademark infringement concerning public interests. Administration for industry and commerce has accumulated abundant experience and made remarkable achievements in trademark infringement governance. However, it is also confronted with various new situations,new challenges and new requirements at the current stage. Taking effective measures to govern trademark infringement is a matter related to national competitive power,international image, economic transformation and upgrading,improvement of public livelihood and the success of business market regulatory system reform. Thus, combing with governance situation and demands, we have to analyze the difficulties and reasons of governance. At the same time, we must put forward practical solutions, which have a theoretical value and realistic meaning on the improvement of trademark infringement governance. So far,few research achievements have been made concerning trademark infringement governance of administration for industry and commerce from a public management angle. Combined with current various new situations and difficulties, this thesis begins with the relevant theory of government market supervision. It conducts a study at five levels including governance concept, governance system, governance pattern,governance target and governance subject, centering on the accomplishment and improvement of trademark infringement governance function of administration for industry and commerce. It also points out that we have to reexamine the administrative governance advantage, improve the political governance resources distribution,speed up the systematic transformation adaption, make top design on institutional adjustment,build credit public system and properly use credit supervision. Moreover,we have to enhance the management of online trading platform and the ability of governing Internet by Internet. At the same time,we should build a governance working mechanism featuring plural subject interaction so as to promote constructive suggestions including social shared governance.
