随着辩护律师阅卷权的逐步完善，关于被追诉人本人是否应享有阅卷权引起了诸多争议。在理论层面上，赋予被追诉人阅卷权是推动控辩平衡、实现有效辩护，从而进一步保障被追诉人诉讼主体地位的要求；在实践中，刑事诉讼法的修改和我国学术界的大量研究提供了立法参考和理论参考，案卷移送制度和现代科技发展为被追诉人阅卷权的行使提供了现实可能性，也解决了诸多后顾之忧。因此，在我国赋予被追诉人阅卷权已经具备充分的必要性和可行性，在未来可根据我国司法实践的特点，允许被追诉人在起诉和审判阶段在辩护律师或值班律师的帮助下或自主申请查阅法律规定范围内的案件卷宗，并设置合理的救济措施对其进行保护。

With the improvement of the Defense Attorneys’ Right of Reading Case Record, there have been many disputes about whether the defendant himself should have the Right of Reading Case Record. On the theoretical level, granting the defendant the Right of Reading Case Record is to promote the accuser-defendant balance, realize effective assistance of counsel, and protect the defendant’s status as the subject of litigation; in practice, the amendment of PRC Criminal Procedure Law and the large amount of research provided by the academic community have provided legislative and theoretical references, and the case record transfer system and the development of modern technology have provided practical possibilities for the defendant to exercise the Right of Reading Case Record, and have also resolved many worries. Therefore, it is necessary and feasible to grant this right in China. In the future, according to the characteristics of Chinese judicial practice, the defendant can be allowed to apply to reading case record autonomously or assisted by the defense counsel or the duty counsel, and check the case record within the scope required in the law. What’s more, it is necessary to set up reasonable remedies to protect this right.
