网络犯罪不同于传统犯罪，它更隐蔽、危害更大、案件更复杂，给各国人民的人身财产安全造成了巨大威胁。近年来，随着网络技术的发展，网络犯罪日益猖獗，形式上也有了极大的变化，原有的国际条约机制难以应对当下复杂严峻的形势。因此，联合国大会决定成立特设委员会，正式开启制定《联合国打击网络犯罪公约》的进程。本文首先介绍了网络犯罪、公约的制定背景，接着本文就前四届会议讨论的关键问题和会议成果予以介绍，然后本文就公约草案各章节的最新规则设计进行阐述，其中也包括各方代表存在分歧的条款，最后本文阐述公约制定过程给国际社会应对网络犯罪所带来的启示。

Unlike traditional crime, cybercrime is more hidden, more harmful and complex, posing a great threat to the personal and property security of people in all countries. In recent years, with the development of cybertechnology, cybercrime has become increasingly rampant and has changed greatly in form. It is difficult for the original international treaty mechanisms to cope with the current complex and severe situation. Therefore, the United Nations General Assembly decided to establish an ad hoc committee to officially start the process of elaborating the United Nations Convention against Cybercrime. This paper first introduces the background of cybercrime and the development of the convention, and then introduces the key issues discussed at the previous four sessions and the results of the meeting. Then it elaborates on the latest rule design of each chapters of the draft convention, which also includes provisions where representatives of all parties disagree. Finally, this paper describes the enlightenment brought by the convention development process to the international community's response to cybercrime.
