着眼现实生活是社会科学研究的出发点。随着我国进入老龄化社会，老龄化问题逐渐成为现实性的议题。犯罪现象是社会问题的集中反映，通过研究犯罪现象，可以揭示某些深层次的社会问题。近年来，老年人中出现的一些现象引起了公共舆论的关注，其中之一是老年人实施性犯罪。就犯罪现象本身来讲，在我国当前的性犯罪人总体中，老年人不是主要的组成部分。然而，在老龄化社会这个背景下，老年人实施性犯罪这种现象可能会涉及一些深层次的老龄化问题。因此，为拓展认识我国老龄化问题的视角，本文立足我国老龄化社会发展这个背景，将老年人实施性犯罪作为认识老龄化问题的特殊社会现象——老年性犯罪加以研究。本文的展开主要包括6个部分。其中，在“引言”部分，主要介绍了研究背景、研究意义、研究思路、研究方法与研究创新等内容。

第一章是老年性犯罪的概念及研究概况。这部分内容主要涉及两个方面。其中，一方面是界定老年性犯罪的概念，另一个方面是国内外关于老年性犯罪的研究概况。概念是研究的策略和工具。在界定老年性犯罪的概念的过程中，本文还提出了分析老年性犯罪的特征、老年性犯罪的影响因素和提出预防建议的两个重要概念，即“性张力”与“老龄生活圈”。

第二章是老年性犯罪的基本特征。这部分内容依据“中国裁判文书网”的数据，通过对不同犯罪年龄的性犯罪群体进行对比，在犯罪人的年龄增长的角度，描述了性犯罪现象的不同特征，并通过对比的方法，分析了老年群体的性犯罪特征与其他年龄群体的性犯罪特征的差异。犯罪现象是随着社会发展特点的变化而变化的。随着我国老龄化的推进，老年性犯罪是否会呈现犯罪人的年龄结构的老化是一个现实问题。在这部分内容中，笔者结合性犯罪数据与我国不同省份的人口老龄化数据，得出了老龄化程度较高的地区出现了性犯罪人的犯罪年龄老化的结论。由此表明，一方面，人口老龄化可能促动着性犯罪人的年龄结构老化；另一方面，当前的老年性犯罪的状况与特征不是固定的。

第三章是老年性犯罪的影响因素。这部分内容修正了传统的犯罪原因“二元论”的分析格局，通过引入人生历程与“老龄生活圈”的视角，在社会与个体相统一的角度，将社会环境、生活环境与人的生活历程作为分析老年性犯罪影响因素的三个维度，并结合老年群体的生活，分析了可能影响老年性犯罪的相关因素。通常来看，老年性犯罪可能仅仅是关乎老年人与性问题的简单社会现象。但是，本文的分析表明，在某种程度上，老年性犯罪是人们在生活过程中形成的某些生活缺陷与老年生活发生作用的结果，“性情结”在老年生活中的异化是导致老年性犯罪的重要因素。

第四章是老年性犯罪的预防。这部分内容共分为两个方面。其中，一个方面在理论的角度分析了预防老年性犯罪的基本含义、预防依据以及基本的预防方法；另一个方面在实务的角度分析当前应对老年性犯罪的主要措施，如预防观念的完善、老年偏见的消除、老年生活质量的提高等。

最后，本文的“结论”部分主要阐述了本文的研究意义、主要研究核心以及可能出现的研究不足等。

在我国老龄化社会，老年性犯罪所反映的问题不仅存在于老年群体中。年老是每个人都可能面临的，老年生活是人生发展中的一个重要阶段。为了确保老年性犯罪研究在我国老龄化社会发展中的现实性，相对于以往的研究，本文突出了三个方面：引入了人生历程与犯罪现象研究的视角；将性犯罪的分析融入老年生活；尝试性地运用了全国的性犯罪数据。

Focusing on real life is the starting point of social science research. With our country entering aging society, the problems about aging have gradually become realistic issues. Criminal phenomenon is a concentrated reflection of social problems, some deep-level social problems can be revealed through research on criminal phenomenon. In recent years, some phenomena among the elderly have attracted attention of public opinions, one of which is sexual offending committed by the elderly. In terms of the criminal phenomenon, the elderly may not be the main component of the current sex offenders in our country. However, under the background of the aging society, sexual offending committed by the elderly may involve some deep-level problems touching aging. Therefore, in order to broaden the perspective of understanding the aging problem in our country, based on the background of the development of the aging society in our country, this paper studies the sexual offending committed by the elderly as a special social phenomenon which is older sexual offending to understand the aging problem. This paper mainly consists of six parts. Among them, the “introduction” mainly introduces the background, significance, ideas, methods, innovations and so on.

   The first chapter is the concept and research overview of older sexual offending. This part mainly includes two aspects. The one is the concept of older sexual offending, on the other hand, it is the research overview of older sexual offending at home and abroad. The concept is the tool of research. In the process of defining the concept of older sexual offending, the paper also puts forward two concepts that include “sexual tension” and “life cycle of older people” to analyze the characteristics of older sexual offending and the influencing factors of older sexual offending and prevention implication.

   The second chapter is the basic characteristics of older sexual offending. According to the data of “China Judicial Documents Online, this part describes the different characteristics of sexual offending from the perspective of the age growth of offenders and analyzes the differences between the characteristics of sexual offending of older group and those of older age groups by comparing sexual offending groups of different criminal ages. The crime phenomenon changes with the social development characteristics. With the advance of aging in our country, it is a practical problem whether the age structure of the criminals of older sexual offending will be aging. In this part, the author draws a conclusion that the aging age of sexual offenders appears in regions with higher aging degree by combining the sexual offending data and the aging population in different provinces of our country. This shows that the aging of the population may promote the aging of the age structure of sexual offenders; on the other hand, the current situation and characteristics are not fixed.

   The third chapter is the causal factors of older sexual offending. The part amends the traditional analysis pattern of “dualism” in the cause of crime, by introducing the perspective of life course and “life circle of the aging”, the social environment, living environment and people’s life course are taken as the three dimensions to analyze the influencing factors of older sexual offending from the perspective of the unity of society and individual. And combined with the life of the aged group, the relevant factors that may affect older sexual offending are analyzed. In general, older sexual offending may be a simple social phenomenon related to the elderly and sexual problems. However，the analysis of this paper shows that, to some extent, the older sexual offending is the result of some life defects formed in the course of life and aging life, and the dissimilation of “the bond of sexuality” in the aging life is an important factor leading to the older sexual offending.

   The fourth chapter is the prevention of older sexual offending. This part of the content is divided into two parts. One aspect analyzes the basic meaning, the basis and the basic methods of prevention of older sexual offending from the a theoretical point of view; another aspect analyzes the main measures to deal with the older sexual offending, such as the improvement of prevention concept, the elimination of the prejudice of aged and the improvement of the quality of life in old age and so on. 

    Finally, the “conclusion” of this paper states the research significance, main research core and research deficiencies and so on.

In aging society of our country, the problems of reflected by the older sexual offending do not exit in the older groups. It is possible to face the being old for everyone, and the old age life is an important stage in life development. In order to ensure the reality of study on the older sexual offending in the development of aging society of our country, compared to previous studies, this paper highlights three aspects: introducing the perspective of life course and the research of criminal phenomenon; integrating the analysis of the sexual offending into the old age life; and using the data of sexual offending from all over the country tentatively.
