随着互联网的高速发展，想要通过网络搜索、掌握他人的信息变得越来越容易。当今网络隐私权主要有两种保护模式：以美国为代表的行业自律主导的模式和以欧盟为代表的法律规制为主导的模式。网络隐私权保护已成为一个热点问题，在私法保护层面，我国民法学界对于隐私权乃至网络隐私权也有一定的研究基础，但在法律制度上，至今仍无明确统一的隐私权概念和隐私权保护的具体规范。 本文就信息化社会的网络隐私权保护展开探究，通过比较研究国内外对于网络隐私权侵权的私法保护规范和救济模式，围绕《侵权责任法》第36条对我国网络隐私权侵权的核心问题进行剖析。从网络隐私权侵权行为的特点入手，分析其侵权责任认定与承担方式，从而对如何完善我国网络隐私权的私法保护模式提出建议。

With the rapid development of the Internet, it is easier to get information of people by means of searching on the Internet in modern society. Today there are two main patterns to protect the Internet Privacy: the industrial self-regulation dominant pattern with US as the representative and the legal regulation-driven dominant pattern with the EU as the representative. Internet privacy has been a hot issue. In the level of private law protection, China’s scholars of Civil Law have some research foundation. But there are no clear and unified concepts of privacy or specific norms to protect it. The essay will talk about the protection of the Internet Privacy in the informationized society by comparing the domestic norms of protection and the relief patterns toward infringement of Internet privacy with international ones and analyze the core problem of the infringement of network privacy with the article 36 of the “Tort Liability Act”. Beginning with the characteristics of the infringement, this essay will analyze the methods of identification and undertaking of the responsibility of infringement and offer advices about how to improve our private protection patterns of the Internet Privacy.
