我国已经进入轻罪时代，在大量的轻罪案件中，轻罪犯罪人面临着严苛的终身性犯罪附随后果，难以复归社会，被迫社会边缘化，成为社会治理的隐患。为了保障轻罪犯罪人的权益，促进轻罪犯罪人回归社会，优化我国的轻罪治理模式，必须对各种泛滥无序的犯罪附随后果进行规制，而轻罪犯罪记录封存制度与其他规制路径相比具有较为突出的优势，符合罪刑相适应原则，与宽严相济的刑事政策相呼应，而且有现行未成年人犯罪记录封存制度的经验支持。基于此，本文从适用对象、封存范围、封存程序、查询条件、封存效力以及封存解除和监督救济等方面对轻罪犯罪记录封存制度进行具体构建，从而保护轻罪犯罪人的正当权益，促进轻罪犯罪人顺利回归社会，推动轻罪治理现代化。

China has entered the era of misdemeanors, and in a large number of misdemeanor cases, the perpetrators of misdemeanors face harsh lifelong consequences attached to their crimes, making it difficult for them to reintegrate into society and forcing them to be socially marginalized, which makes them a hidden danger to social governance. In order to safeguard the rights and interests of misdemeanor offenders, promote the return of misdemeanor offenders to society and optimise our misdemeanor governance model, it is necessary to regulate a variety of widespread and disorderly criminal collateral consequences. Compared with other regulatory approaches, the system of sealing criminal records for misdemeanors has prominent advantages, conforms to the principle of adapting crime to punishment, and echoes the criminal policy of temper justice with mercy. And it has the experience support of the current juvenile criminal record sealing system. Based on this, this paper specifically constructed the misdemeanor criminal record sealing system from the aspects of applicable objects, scope of sealing, sealing procedures, query conditions, sealing effectiveness, sealing removal and supervision and relief, so as to protect the legitimate rights and interests of misdemeanor offenders, promote the smooth return of misdemeanor offenders to society, and promote the modernization of misdemeanor governance.
