近年来,随着我国经济快速发展,国民收入水平迅速提升,汽车开始进入越来越多的家庭,购买汽车已经成为越来越多人的首要考虑事项。在巨大的市场需求刺激下,我国汽车市场在近十年来始终处于快速发展的状态。根据中国汽车工业协会统计数据显示,我国2018 年汽车产销量均在 2800 万辆左右,连续十年蝉联全球第一大汽车市场。截至 2019 年初,公安部发布的 2018 年全国汽车保有量数据显示,我国小型载客汽车保有量突破 2 亿辆①。由于一些历史原因,加上汽车市场发展超出政府规划预期,停车位的建设远远滞后于私家车保有量的增长,导致停车位成为稀缺资源。当前,住宅小区内出现的“停车位权属争议”、“停车难”、“乱停乱放”等现象,已经成为社会焦点话题。

《中华人民共和国物权法》等法律法规虽然对住宅小区内停车位权属有相关的规定,但因为表述过于概括,可操作性不强,且部分规定表述的不清晰、容易引发歧义,加之又没有出台相应的实施条例或细则,因而无法从根本解决停车位权属争议等问题。本文主体部分共 8 章,内容简要如下:

1 章:提出本论题的研究背景和研究意义,概述国内外关于住宅小区停车位权属的研究现状,明确研究目标、拟解决的关键问题及研究方法,总结本论题研究的创新之处及不足;

2 章:对住宅小区停车位涉及的相关概念,如“地面停车位”、“地下人防车库”和“地下非人防车库”,分别进行阐述,并提出本论题的理论基础;

3 章:针对社会上住宅小区停车位权属争议等问题,对珠海市代表性住宅小区进行实地调研,并详述调研住宅小区停车位权属现状;

4 章:根据实地调研结果,总结并分析珠海市住宅小区停车位存在的权属相关问题;

5 章:对物权法等法律法规涉及住宅小区停车位相关条款进行剖析;

6 章:借鉴国内外关于住宅小区停车位权属相关已有研究经验;

7 章:结合土地出让分析住宅小区停车位权属,并从建筑物的构成条件、地下限定深度内的建设用地使用权、建筑成本等方面,对住宅小区三类停车位权属展开合理性分析;

8 章:针对国内住宅小区停车位存在的权属争议等问题,提出解决建议并分析由此可能引发的问题。


外文摘要:

 In recent years, with the rapid development of China's economy and the rapid improvement of the national income level, automobiles begin to enter more and more families, and the purchase of automobiles has become the first consideration for more and more people. Under the stimulation of huge market demand, China's automobile market has been in a state of rapid development in the past decade. According to the statistics of China Automobile Industry Association, China's automobile production and sales volume in 2018 are all around 28 million, ranking the world's largest automobile market for ten consecutive years. As of the beginning of 2019, the national car ownership data in 2018 released by the Ministry of public security shows that the number of small passenger cars in China has exceeded 200 million. Due to some historical reasons, coupled with the development of the automobile market exceeding the government's expectation, the construction of parking spaces is far behind the growth of private car ownership, resulting in parking spaces becoming a scarce resource. At present, the phenomenon of "dispute on the ownership of parking space", "difficult parking", "disorderly parking" and so on has become a social focus topic.

The property law of the people's Republic of China and other laws and regulations have relevant provisions on the ownership of parking spaces in residential areas, but because the expression is too general, the operability is not strong, and some of the provisions are not clear, easy to cause ambiguity, and there is no corresponding implementation regulations or rules, so it is impossible to fundamentally solve the disputes on the ownership of parking spaces. The main body of this paper consists of six chapters, which are as follows:

 Chapter 1: Putting forward the research background and significance of this topic,summarize the research status of parking space ownership in residential areas at home and abroad, clarify the research objectives, key problems to be solved and research methods, and summarize the innovation and shortcomings of this topic;

Chapter 2: The relevant concepts of parking spaces in residential areas, such as "ground parking space", "underground civil air defense garage" and "underground non civil air defense garage", are described respectively, and the theoretical basis of this thesis is put forward;
    Chapter 3: In view of the disputes on the ownership of parking spaces in residential areas in the society, the representative residential areas in Zhuhai are investigated on the spot, and the status quo of the ownership of parking spaces in residential areas is described in detail

    Chapter 4: According to the results of the field survey, this paper summarizes and analyzes the ownership related problems of the parking spaces in the residential quarters of Zhuhai

    Chapter 5: Analyzing the relevant provisions of the real right law and other laws and regulations concerning the parking space of residential quarters

    Chapter 6: Learning from the domestic and foreign research experience on the ownership of parking spaces in residential areas

    Chapter 7: Combining with the land transfer analysis of the residential area parking rights, and from the composition of the building conditions, the underground limited depth of the construction land use rights, construction costs and other aspects, the residential area of the three types of parking rights to carry out a reasonable analysis

    Chapter 8: In view of the ownership disputes of parking spaces in domestic residential areas, the paper puts forward some suggestions and analyzes the problems that may arise.
