信息网络技术的发展在方便人们生活的同时，也为社会治理和犯罪规制带来了巨大的挑战。网络环境下，著作权也发生了巨大变化，作品传播速度更快、作品传播影响更广，侵犯著作权的犯罪行为更加隐蔽、社会危害性更加严重，这一系列变化都对我国著作权刑法保护体系提出了更高的要求。 我国刑法在面对网络环境下著作权犯罪时的滞后性表现得比较明显，应对新情况、新问题时显得力不从心。本文针对网络环境下著作权犯罪发展新挑战，结合域内外立法，对我国著作权刑法体系的不足进行论述，并提出相关修改建议。 本文除引言外，共四个部分。在引言部分简述了本文的选题背景和行文逻辑，为正文展开做铺垫。第一部分是网络环境下著作权刑法保护概述。主要对网络环境下著作权表现出的新特点进行总结和归纳，同时对我国现阶段著作权刑法保护的现状进行分析。第二部分是我国网络环境下著作权刑法保护存在的问题，主要是从立法模式、立法内容、刑法与其他部门法衔接三个方面，系统分析论证了我国著作权刑法制度在面对网络环境下著作权刑法保护问题上遇到的冲击和挑战。第三部分是域外对网络环境下著作权的刑法保护。该部分首先对国际条约和著作权法律制度比较发达的典型国家的相关制度进行了分析，同时归纳总结域外著作权刑法保护的经验和发展趋势。第四部分是我国网络环境下著作权刑法保护的完善。该部分首先对网络环境下著作权刑法制度发展应遵循的原则和理念进行明确，为著作权刑法制度的研究提供方向。然后就现行著作权刑法制度的修改和完善提出建议。
