在高校与学生的法律关系中，无论是在法律授权的教育领域，还是在法律未授权的日常生活领域和政治领域，往往存在高校利用管理权限制学生权利的现象，并且这类限制学生权利的行为不具有宪法正当性。由于国外大学长期重视学生权利，在学生事务管理领域的经验比较丰富，本文在吸收国外成熟管理经验的基础上，同时结合我国学生事务管理的现实情况，针对上述三个领域，尤其是日常生活领域，提出一套相对全面且合理可行的后勤社会化改革措施，最大程度的保护学生的权利。

In the legal relationship of universities and students, whether in the realm of education where universities are authorized or in the realm of daily life and politics without authorization, the phenomenon that universities use their power of management to restrict students’ rights are usual. These acts of restricting students’ rights are lack of constitution legitimacy. Since overseas universities have been valuing students’ rights for a long time, they have rich experience in the field of students affair management. To protect students’ rights to the uttermost, this thesis would assimilate foreign mature managerial experience and be aware of the current situation of students affair management in China. Of the three realms mentioned above, especially on daily life, an relatively overall feasible reform measures of logistics socialization would be proposed.
