随着《物权法》的颁布和施行,建筑物区分所有权制度作为一项重要的法律制度已经在我国初步得以建立。然而,在现行立法的基础上仔细考察司法操作的过程,我们仍然感觉到《物权法》中对于建筑物区分所有权的相关规定略显不足,特别是对于建筑物区分所有权的专有所有权和共有所有权客体范围规定得尤为简单。本文从建筑物区分所有权的基本理论入手,重点探讨和论述建筑物区分所有权中专有权和共有权的客体范围,特别是在司法实践中纠纷和争议较多的共有权部分,如建筑物外墙、顶层空间、地下停车场以及小区绿地等的归属问题。最后,本文对 《物权法》中的相关条文进行评述,并对立法完善提出建议。

外文摘要:

As the promulgation and execution of the Real Law, the building differentiation ownership system is preliminarily set up as an important system of law in our country. However, if reviewing attentively the operating process of judicature on the base of existing legislation, we still sense that the Real Law is a little cursory when referring to the building differentiation ownership, especially to the objective extension of exclusive right and common right of it. Starting with the basal theories of the building differentiation ownership, this article mainly probes into and discourse upon the objective extension of exclusive right and common right of the building differentiation ownership, particularly the latter one, which more frequently controversy in judicial practice,for example,the proprietorship of bounding walls of buildings,attic space, underground parking lots, or greenbelts of communities. While passing judgment on the relevant byelaws in the Real Law, my article also tables proposals for legislative amendment in the end.
