从构建中国特色社会主义法律体系到构建中国特色社会主义法治体系,我国法治现代化的总体目标正在发生由以规范为基础的制度体系现代化向以执行为导向的运行模式现代化的巨大转变。在教育法治领域,随着我国教育政策与法律体系的基本建立与不断完善,加强和改进教育行政执法工作,作为深化教育领域综合改革,推进教育治理体系和治理能力现代化的重要一环,对于保证教育事业快速、健康、可持续发展具有重要意义。 当前,中国特色社会主义进入新时代,我国教育事业也发展到了新阶段,教育改革的复杂程度、教育资源的供求关系、教育行政的内在逻辑、教育行政的外部环境都发生了重要而深刻的变化,这给教育行政执法提出了新的时代要求。我们需要深刻把握新时代我国教育事业发展的阶段性特征,突出制度建设与机制创新的基础性、战略性、前瞻性作用,立足教育行政执法的特殊性,充分发挥多方主体在教育行政执法过程中的积极作用,妥善协调、处理教育行政系统与外部社会环境之间,教育行政系统内部纵向与横向间的复杂关系,建立健全教育行政执法的协同机制。 本文中“教育行政执法协同机制”是指:为实现多样化的教育行政管理目标,保证教育政策与法律得以正确、高效实施,在教育行政机关(包括内部职能科室和直属事业单位)、教育督导机关、其他领域行政机关、基层街镇组织、行业协会等社会力量以及行政相对人(包括学校等教育机构、学生及其家长)之间建立的,以沟通、协商与合作为基本价值取向的,以行政执法资源共享为核心内容的,以综合性和网络化为主要特征的相互作用关系,以及与此相关的运行方式。 本文围绕建立和完善教育行政执法协同机制这一主题,开展理论研究和实证研究。对教育行政执法协同机制这一核心概念进行了辨析与界定,具体讨论了教育行政执法协同机制的类型化、制度功能与价值指引三方面问题,并对其形成机理进行了剖析;较为全面地总结了我国部分地区教育行政执法协同机制的实践情况,并对其中存在的不足进行了分析;构建了关于教育行政执法协同机制的分析框架,明确了影响其形成与制约其功能发挥的若干因素,并将其理论化、模型化;提出了建立与完善教育行政执法协同机制的若干建议。 论文主体分为四个部分: 第一部分,对教育行政执法协同机制的相关理论问题进行研究,界定了教育行政执法协同机制的内涵与外延,概括了其基本特征,并对教育行政执法协同机制进行了类型化分析:按协同主体,可以大致划分为“教育行政系统内部协同机制”与“教育行政执法跨部门协同机制”两大类;按协同的层面,可将教育行政执法协同机制划分为“结构性协同机制”和“程序性协同机制”两类。之后,分析了教育行政执法协同机制的四大功能(组织结构整合、信息资源整合、执法业务整合、行政服务整合)与四大价值取向(以实现多样化行政目标为动力、以多元治理与服务行政为引领、以非强制性手段的运用为特色、以实现法律效果与社会效果相统一为目的);最后,分析了教育行政执法协同机制的形成机理。 第二部分,基于对教育行政执法体制改革试点单位以及先期探索单位的访谈和资料收集,从教育行政系统内部协同机制与教育行政执法跨部门协同机制两个方面,较为系统地分析、归纳了当前教育行政执法协同机制的实践情况。调查表明,现阶段我国教育行政执法协同机制建设虽然取得了重大进展,但仍存在诸多问题。具体包括如下七个方面:(1)制度供给不足难以满足外部指导型协同的发展需要;(2)具体制度安排不合理影响协同机制效能发挥;(3)教育行政执法协同机制的资源依赖关系存在明显失衡现象;(4)教育行政执法协同机制中初始性领导力有待进一步加强;(5)教育行政执法信息化建设相对滞后制约教育领域服务行政的开展;(6)协同机制建设缺少系统设计与统筹谋划;(7)教育行政执法队伍建设相对滞后。 第三部分,在对现实问题进行分析的基础上,借鉴相关理论的有益经验,从机制形成与效能发挥两个角度归纳出教育行政执法协同机制的影响因素,包括环境要素(教育资源供求状况、政策与法律环境、经济社会发展水平、权力关系、历史关系)、驱动力要素(棘手问题、资源依赖关系、内部激励或外部刺激、初始性领导力)、资源要素(专业知识、信息、权力、行动能力),并在此基础上引入认知一致性、共同动机、联合行动的能力这三个条件,构建出教育行政执法协同机制的分析模型,并具体讨论了模型的现状阐释功能与问题诊断功能。 第四部分,综合理论分析、调研结果以及德尔菲法问卷调查,从明确教育行政执法协同机制建设的重点领域,切实改进教育行政系统内部协同,着力提升教育行政机关与其他行政机关的协同效果,创新与社会力量和行政相对人之间的协同,进一步加强顶层设计和制度供给,加快教育数据信息系统与服务平台建设,全面加强执法队伍与执法能力建设等七个方面提出了完善教育行政执法协同机制的建议。

From constructing the socialist legal system with Chinese characteristics to constructing a socialist rule of law system with Chinese characteristics, the overall goal of the modernization of the rule of law in China is undergoing a great change from the norm-based system modernization to the implementation-oriented modernization. In the field of the rule of law in education, with the basic establishment and improvement of the educational policy and law system in China, strengthening and improving the implementation of education policies and laws, as an important part of deepening the comprehensive reform in education and promoting the modernization of governance system and governance capacity in education, are critical for maintaining the rapid, healthy and sustainable development of education. At present, the socialism with Chinese characteristics has developed into a new era, China's education has developed into a new stage as well. The complexity of educational reform, the supply and demand of educational resources, and the internal logic and external environment of educational administration have undergone profound changes, which put forward the new era requirement for the implementation of education policies and laws. It is essential to grasp the stage characteristics of educational development in the new era, highlight the basic, strategic and leading roles of the system construction and mechanism innovation, base on the particularity of the implementation of educational policies and laws, give full play to the positive function of the multiple parties in the implementation of educational policies and laws, and properly deal with the relationships not only between educational administrative department and external social environment, but also between the vertical aspect and horizontal aspect within the educational administration system, so as to improve the collaborative mechanism of the implementation of educational policies and laws. The "collaborative mechanism of educational administrative law enforcement" means that, in order to achieve diversified educational administration goals, ensure the correct and efficient implementation of educational laws and policies, the comprehensive and networking functional relationship and related working mode are made between the internal units of administrative department of education(ADE)(including the internal functional units and affiliated units), the educational supervision departments, the administrative departments of other fields, and the grass-roots ADE, guilds and other social organizations, the administrative counterparts(including schools and other educational institutions, students and their parents), with communication, consultation and cooperation as the basic value, with the sharing of administrative resources as the core contents. Based on the theme of establishing and improving the collaborative mechanism of educational administrative law enforcement, this paper carries out theoretical research and empirical research. The core concept of the “collaborative mechanism of educational administrative law enforcement” is analyzed and defined, three aspects of typology, function and value guidance of collaborative mechanism of educational administrative law enforcement and its formation mechanism are discussed. The practical situation and shortcomings of collaborative mechanism of educational administrative law enforcement in some areas in China are summarized and analyzed as well. The analysis framework based on several factors of collaborative mechanism of educational administrative law enforcement is constructed. What’s more, some suggestion for improving collaborative mechanism of educational administrative law enforcement is proposed. The main body of the paper can be divided into four parts: In the first part, the related theoretical problems of the collaborative mechanism of educational administrative law enforcement are studied, including the definition of the connotation, extension and basic characteristics of the educational administrative law enforcement and the systematical analysis on it. According to the subject of coordination, it can be roughly divided into the internal collaborative mechanism and the cross-sectors one. According to the level of collaboration, it can be divided into two types: "structural collaborative mechanism" and "procedural collaborative mechanism". After that, the four integration functions in terms of organizational structure, information resources, procedures and administrative services are analyzed. Besides, the four major values, that is, achieving multiple administrative goals as driving forces, embracing multiple governance and service-oriented administration as guidance, realizing the unification of legal effect and social effect as purpose, using unforced means as features, are explored. Finally, the formation mechanism of the educational administrative law enforcement is discussed. In the second part, based on the on-the-spot interview and data collection, the situation of current collaborative mechanism is systematically analyzed from the two aspects. It shows that although there has been significant progress in the construction of the collaborative mechanism of educational administrative law enforcement at this stage, there are still following problems: (1) the insufficiency of institutional supply; (2) the irrational institutional arrangements; (3)the imbalance of resource interdependence; (4) The unqualified leadership; (5) the low level informatization of educational administrative law enforcement; (6) the lack of systematic designing and overall planning; (7) the raw team construction and development. In the third part, based on the analysis of situations, problems and existed theories, several influence factors are summed up, including the environmental factors (the supply and demand of educational resources, the policy and the legal environment, the level of economic and social development, power relationship, historical relationship), the driving forces(difficult issues, resource interdependence, internal and external incentives, initial leadership), resource elements (professional knowledge, information, power, and capabilities of action ). The analysis framework is created based on above influence factors, with additional conditional factors of cognitive conformance, common motivation, and capacity of joint action. Finally, the explanation function and diagnosis function of the framework are discussed. In the last part, based on comprehensive theoretical analysis and Delphi questionnaire survey, the promoting approaches for perfecting the collaborative mechanism of educational administrative law enforcement are proposed from the following aspects: (1) to achieve breakthrough from the key areas; (2)to promote the collaboration in educational administrative system; (3)to develop the collaboration between the administrative agency in education field and the ones of other fields; (4)to innovate the collaboration with social organizations and administrative counterparts; (5)to strengthen the top level designing and institution supply; (6) to speed up the construction of educational data and information system and services platform; (7) to comprehensively enhance team development and capacities.
