实施全民健身计划是国家重要发展战略，其得以落实不仅有利于人们增强体魄，获得幸福生活，更标志着国家综合实力的提升和社会整体的进步。而社区健身，因受众范围广，无疑是全民健身体系中重要的组成部分。社区健身形式多样，除了广受欢迎的广场舞，还有甩鞭、抽陀螺、篮球等，这些健身项目的蓬勃发展确实给人们的身心健康带来一定积极作用。但由此所产生的噪声污染问题以及引发的各类纠纷同样也不容忽视。尤其是近年来被社会广泛关注的广场舞扰民现象，由于参与群体的范围不断扩大，其伴奏音乐所产生的噪声已然对人们的生活产生很大影响，由此引发的矛盾冲突更是上升为了一种社会难题。此类社区噪声污染发生频率远远高于其他噪声类型，对居民的日常生活和社区的和谐安定具有不可估量的严重影响，因此对社区健身运动所致噪声污染进行研究具有重要的现实意义。 社区健身所致噪声污染问题也并非无法律上的规制。《环境噪声污染防治法》、《治安管理处罚法》等相关法律法规明令禁止在建筑物集中区域使用高音广播喇叭的行为，并且规定了公安机关相应处理办法。另外为了进一步规范广场舞活动，国务院相关部门近年来也相继出台了一系列《通知》，对于健身场地、服务、经费以及禁止性行为等内容都加以明确规定。但不可否认，上述规制主要是针对广场舞，恰恰忽略了甩鞭、抽陀螺等传统健身项目以及很多新兴健身活动都可能成为噪声污染源的现实。当面对此类噪声扰民纠纷时，公安机关很容易陷入执法困境。当然，社区健身所致噪声污染的背后还涉及公民体育权利难以得到充分保障等问题，虽然《全民健身计划2016-2020》明确了社区健身的目标、内容和实现路径，但所规定内容较为笼统，宽泛，这都必然增加社区健身所致噪声污染的治理难度。 本文共选取了两起实务案例，通过对案例进行分析，并结合现状，总结出社区健身所致噪声污染背后的问题表现；再从立法、执法、守法三个维度分析社区健身所致噪声污染产生的原因；最后借鉴国内外先进的做法，从上述三个维度提出相应的对策建议。

The implementation of the National Fitness Program is an important national development strategy. Its implementation is not only conducive to enhancing people's physique and achieving a happy life, but also symbolizes the improvement of the comprehensive strength of the country and the progress of the society as a whole. Community fitness, because of its wide audience, is undoubtedly an important part of the national fitness system. There are various forms of community fitness. In addition to the popular square dance, there are also whip throwing, gyroscope pulling, basketball and so on. The vigorous development of these fitness programs has indeed brought positive effects on people's physical and mental health. However, the noise pollution problem and various disputes caused by it can not be ignored. Especially in recent years, the phenomenon of disturbing people by square dancing has been widely concerned by the society. As the scope of the participating groups is expanding, the noise produced by the accompaniment music has had a great impact on people's lives, and the contradictions and conflicts caused by it have risen to a social problem. The frequency of noise pollution in this kind of community is much higher than other types of noise, which has immeasurable serious impact on residents 'daily life and community harmony and stability. Therefore, it is of great practical significance to study the noise pollution caused by community fitness exercise. Noise pollution caused by community fitness is not without legal regulation. The Law on the Prevention and Control of Environmental Noise Pollution and the Law on Punishment of Public Security Administration and other relevant laws and regulations stipulate that the use of high-pitch loudspeakers in concentrated areas of buildings is prohibited, and the corresponding treatment measures of public security organs are stipulated. In addition, in order to further standardize square dance activities, the relevant departments of the State Council have issued a series of "Notices" in recent years, which clearly stipulate the fitness venues, services, funds and prohibited sexual activities. However, it is undeniable that the above regulations are mainly aimed at square dancing, which neglects the fact that traditional fitness programs such as whipping, gyroscope pulling and many new fitness activities may become sources of noise pollution. When confronted with such noise disturbing civil disputes, the public security organs will easily fall into the dilemma of law enforcement. Of course, the problem of noise pollution caused by community fitness also involves that it is difficult to fully protect citizens' sports rights. Although the "National Fitness Program 2016-2020" clearly defines the objectives, contents and implementation path of community fitness, the provisions are relatively general and the effectiveness of the implementation of documents is not high. This will inevitably increase the difficulty of noise pollution control caused by community fitness. This paper selected two practical cases, through case analysis, combined with the current situation, summed up the problem behind the noise pollution caused by community fitness; then analyzed the causes of noise pollution caused by community fitness from three dimensions: legislation, law enforcement and law-abiding; finally, draw lessons from advanced practices at home and abroad, put forward corresponding countermeasures and suggestions from the above three dimensions.
