近年来，电商平台型互联网医院利用其流量、物流等优势，在问诊、购药等方面为患者提供优质便捷的医疗服务，但是电商平台型互联网医院涉及的主体增多，且我国并未出台专门的法律法规对网络医疗中的侵权责任予以规范。本文分析了电商平台型互联网医院的运作模式，并从雇主替代责任理论遭到质疑、侵权责任承担主体混乱、互联网诊疗信息基础薄弱三个方面剖析电商平台型互联网医院模式下的现存法律问题，对该模式下医生、患者、电商平台型互联网医院、第三方机构之间的民事法律关系进行辨析，从问诊环节导致的侵权责任承担、购药环节导致的侵权责任承担、检验环节导致的侵权责任承担几个方面讨论电商平台型互联网医院模式下的侵权责任承担主体，并从合理运用追偿权规则、优化侵权责任承担以及强化信息安全建设三个方面对电商平台型互联网医院模式下现存法律问题予以回应。

In recent years, e-commerce platform Internet hospitals have taken advantage of their advantages in traffic and logistics to provide patients with high-quality and convenient medical services in terms of consultation and drug purchase, but the number of entities involved in e-commerce platform Internet hospitals has increased, and China has not issued special laws and regulations to regulate tort liability in online medicine. This paper analyzes the operation mode of e-commerce platform Internet hospitals, and analyzes the existing legal problems under the e-commerce platform Internet hospital model from three aspects: the theory of employer's vicarious liability is questioned, the subject of tort liability is confused, and the Internet diagnosis and treatment information foundation is weak. This paper discusses the subject of tort liability under the e-commerce platform Internet hospital model, and responds to the existing legal problems under the e-commerce platform Internet hospital model from three aspects: reasonable application of the right of recourse rules, optimizing the subject of tort liability, and strengthening information security construction.
