对于进入国内市场的外国投资来说，中国40年的经济开放性具有巨大的吸引力。 前不久，中国因实行强制性技术转让并为其国内公司而非外国公司提供优惠待遇而受到批评。 虽然中国2019年对整个《外国投资法》进行了改革，并于2020年开始实施，但对于在中国投资的外国人而言，他们很难获得有关外国投资先决条件的可靠和最新的法律信息。 本项研究对有关允许外国直接投资进入中国的法律进行了翻译，涉及中外合资企业，中外合作合资企业，外商独资企业，包括在2019年《外国投资法》改革的前后设立的外国代表处和外国企业，并强调了对已经在中国成立的外国公司的法律制度的相应修改.

本文从相关法律对外国投资市场准入的影响这一视角，来让投资者全面地了解中国从1978年邓小平的改革开放政策到2020年的《外国投资法》以来关于外国投资的体制及其演变。本文在比较同一文档的各种翻译后仍存在不确定性时，均引用的是中文官方资料。

China has 40 years of economic openness and attractiveness toward the entrance of foreign investment in its domestic market. Recently China has been criticized for practicing forced transfers of technology and providing preferential treatment to its domestic companies rather than to foreign ones. However, in 2019 a reform of the whole Foreign investment law was engaged and its application starts in 2020.

It may be very hard for a foreigner willing to invest in China to obtain credible and updated legal information concerning the pre-establishment treatment of foreign investments. This study used various translation of all the laws concerning the legal regime of every kind of foreign direct investment in China such as Sino-Foreign equity joint venture, Sino-Foreign cooperative joint venture, Wholly Foreign-owned enterprise and even representative office before and after the 2020 reform of foreign investment Law and highlight the modifications of legal regime for the already established foreign companies in China. The investors willing to have a piece of exhaustive information concerning the regime of Foreign investment and its evolution since the opening reforms and policy of Deng Xiaoping occurred in 1978 to the 2020 Foreign investment Law may find in this study the presentation of their legal aspects and implications to the entrance in the market of foreign investments. This study referred to official Chinese sources each time uncertainty remained after comparison of various translations of the same document.
