随着数字经济时代的到来，包括我国在内的多个国家都开展了法定数字货币的研发工作。目前我国已在国内多个地区开展了数字人民币试点，其正式流通已势在必行。然而，数字人民币在全国范围内广泛流通，需要具备相应的法律制度。数字人民币法律体系亟需构建。目前学界以及实务界对于数字人民币立法模式的选择主要有单独立法、仅对现有法律进行完善以及对我国的货币法进行系统整合三种观点。综合来看，笔者认为对数字人民币单独立法是最佳的立法路径，这样不仅能够在立法时充分体现数字人民币的特性，还能兼顾立法的效率与科学性，满足数字人民币的发展需求。具体立法体例的选择，笔者认为制定行政法规较为合适。法规的框架可以按照总则、数字人民币的运行规范、数字人民币的监管体系以及处罚措施的思路进行构建，针对数字人民币的特性以及货币本身均需遵循的规则设计条文，保证立法的系统与完善，促进数字人民币的健康发展。

With the advent of the digital economy era, many countries, including China, have carried out research and development work on legal digital currencies. At present, China has launched pilot projects for digital renminbi in multiple regions of the country, and its official circulation is imperative. However, the widespread circulation of digital renminbi across the country requires corresponding legal systems. The legal system of digital renminbi urgently needs to be established. At present, there are three main views in academia and practice regarding the legislative model of digital renminbi: separate legislation, only improving existing laws, and systematically integrating China's currency law. Overall, the author believes that the best legislative path is to legislate separately for digital renminbi. This not only fully reflects the characteristics of digital renminbi in legislation, but also balances the efficiency and scientificity of legislation, meeting the development needs of digital renminbi. The author believes that it is more appropriate to formulate administrative regulations for the specific legislative style selection. The framework of regulations can be constructed according to the general principles, operational norms of digital renminbi, regulatory system of digital renminbi, and punishment measures. Articles should be designed based on the characteristics of digital renminbi and the rules that currency itself must follow to ensure the systematic and perfect legislation, and promote the healthy development of digital renminbi.
