公共场所的控烟法律问题研究在世界范围内已经开展多年,近些年我国也加快了公共场所控烟法律问题研究的步伐。2003年通过的《烟草控制框架条约》,使世界各国的控烟工作得到前所未有的发展,2006年,《公约》在我国正式生效,至2011年1月我国应当履行在公共场所全面控烟的承诺。本文以我国公共场所控烟的法律问题为着眼点,在理论研究的基础上通过分析,以求解决我国公共场所控烟面临的法律问题。 本文以“我国公共场所控烟法律问题研究”为题,全文共分五章。主要内容为: 第一章,我国在公共场所进行控烟的必要性。吸烟对烟民自己、被动吸烟者、社会都有着很大的危害,它严重危及人的身体健康,浪费大量医疗资源,造成大量生产力的丧失,因此我们应该在公共场所进行控烟。 第二章,公共场所控烟首先要明确的几个问题。我们在公共场所进行控烟,需要先明确以下三个问题:由于吸烟并不具备权利的三个属性即法律性、自主性和利益性,因此吸烟至多是一种自由而非权利;通过举例,以及对公约宗旨的解读和现实情况的分析,得出了在当前环境下我们为什么选择“控烟”而不是“禁烟”;通过对自觉行为和非强制性规定控烟失败的分析,明确立法是目前情况下控烟的最佳选择。 第三章,国际国内控烟立法现状。2003年,《烟草控制框架条约》通过以后,爱尔兰,美国,新加坡等国已经开始积极履行公约的义务。我国自1979年开展控烟工作以来,相继颁布了20余条有关烟草控制方面的规范性法律文件,但并没有一部专门针对公共场所禁止吸烟的全国性法律规范,有关规定均出现于相关法律法规的某些条款或细则中。 第四章,我国公共场所控烟立法存在的问题。我国虽然从国家层面和地方层面都制定了一系列控烟的条例、规定,但是在措施上仍然与公约差距很大。主要表现为立法本身上存在着数量少且不够与时俱进,执行监督不够完善等问题,在立法内容上存在着内容粗糙、不明确,控烟的公共场所范围过小,惩罚机制不够完善等问题。 第五章,公共场所控烟具体问题分析。通过描述公约对公共场所范围的指导性解释,结合我国现行法律法规中关于公共场所的规定,对经营性场所、体育场馆等做了探讨,并对我国公共场所的范围提出立法建议。执法主体的确定是立法在制定过程中遇到的最主要难点问题,通过对比分析多种管理模式,提出建立“以卫生部门为主导,其他部门协助,专门部门协调”的多元化主体的建议,并将增设“场地管理者”和“禁烟监督专员”作为辅助措施。通过描述部分国家公共场所的惩罚状况,提出了我国确立控烟立法处罚方式的基本原则:以教育为主,惩罚为辅;罚款为主,手段多元;额度适当,威慑力强。控烟,一个关涉民生的重大问题,对控烟立法的研究,对当前社会具有着重要的意义。

The research on the legal problems of tobacco control in public places in the world have been carried out for many years.In recent years,China has accelerated the pace of research on tobacco control laws in public places.In 2003,FCTC,which has an unprecedented development of the world’s tobacco control efforts.In 2006,the convention entered into force in China.In 2011 China should perform comprehensive tobacco control commitment in public places.The article take our country public tobacco control legal problems as a starting point,through the analysis on the basis of theoretical studies,in order to solve the legal problems of China tobacco control in public places. The article with "The research on tobacco control legal issues of China in public places".The text is divided into five chapters.The main contents are: The first chapter,China has necessity for tobacco control in public places.Smoking has a great harm of smokers,passive smokers and society,which seriously endanger people’s health,waste a lot of medical resources,resulting in massive loss of productivity,so we should control smoking in public places. The second chapter,tobacco control must clear several issues in public places.We need to make clear the following three issues:smoking does not have rights to three properties that legal nature,autonomy and interests,so smoking is free rather than rights.By way of example and for the purposes of the convention’s interpretation and realistic situstion analysis,draw the conclusion why do we choose "under control "rather than "smoking",through the analysis of conscious acts and non mandatory for tobacco control failure analysis.The lefislation is the best choice for tobacco control at present. The third chapter, the status quo of the international and domestic tobacco control legislation. 2003, FCTC through ,Ireland, the United States, Singapore and other countries have begun to actively fulfill the obligations of the Convention. Since the tobacco control carried out work in 1979, China promulgated more than 20 normative legal documents on tobacco control, but no one for smoking bans in public places nationwide legal norms specifically, the relevant provisions of the relevant certain provisions of laws and regulations or rules. The fourth chapter , the problems of public places tobacco control legislation. Although from national and local levels in China have developed a series of tobacco control ordinances, regulations, but still great gap with the Convention measures. Mainly on the legislation itself there is a small number enough times, inadequate implementation monitoring problems, there is content in the legislative content of the rough, is not clear, tobacco control in public places is too small, inadequate punishment mechanism problem. The fifth chapter , the specific issues of public places, Tobacco Control. By describing the Convention to explain the guidance range of public places, combined with China's existing laws and regulations on public places, business establishments, stadiums and other do, and the scope of our public places to make legislative proposals. Enforcement body to determine the most important and difficult issues encountered by the legislation making process, by comparing a variety of management models, proposed the establishment of the diversification of the main recommendations led to the health sector, the assistance of other departments, specialized sectoral coordination ", and additional "site managers" and "Smoking supervision of the Commissioner" as a supplementary measure. Describe the punishment of public places in some countries, the basic principles of the established tobacco control legislation punishment in China: education, supplemented by punishment; fine-based, multi-means; the amount of appropriate deterrence and strong. Tobacco Control, a big problem about people's livelihood ,in the study of tobacco control legislation, has an important significance to the current society.
