随着市场经济的不断发展，在国内外司法实践中出现了驰名商标弱化、丑化、退化等商标淡化的新问题、新案例，对驰名商标的保护也提出了新的要求。从驰名商标受保护的发展来看，反淡化保护已成为一种国际趋势。美国、德国等发达国家的反淡化立法已经相当完善，而我国的反淡化保护却相对薄弱，仅在个别法律条文和行政规章中对降低商标识别性的淡化予以附带规定，效力位阶较低，而且缺乏可操作的具体规范。鉴于此，本文以现有的研究理论和商标立法为基础，以定性研究为重点，以方法探索为突破，分四个部分对驰名商标淡化的认定和反淡化保护进行阐述: 第一部分，通过阐述驰名商标淡化的基本内涵，界定驰名商标淡化的性质，介绍驰名商标淡化的构成要件，分析驰名商标淡化的表现形式，对驰名商标淡化行为进行认定; 第二部分，概括国外驰名商标淡化理论的发展情况以及反淡化保护情况，旨在更全面地研究商标淡化理论，也为我国驰名商标反淡化保护提供借鉴; 第三部分，介绍我国驰名商标反淡化保护的相关规定，肯定我国驰名商标反淡化保护取得的成绩，明确我国驰名商标反淡化保护的短板和不足; 第四部分，借鉴国外驰名商标反淡化保护的立法经验，从我国的实际情况出发，探索我国驰名商标反淡化保护的道路和方法。

With the development of the market economy, there are more and more new casese about well-known trademark dilution. Trademark dilution causes trademark infringement. At the same time, trademark anti-dilution protection has become an international trend. America, Germany etc. developed countries have entirely legislations on trademark anti-dilution protection. In contrast, trademark anti-dilution protection in China has many things to do. The writer launches a more sound research to dilution theory and refers many cases of trademark dilution to complete this article. Based on many kinds of useful theories on trademark anti-dilution protection, there are four parts in this article. In the first part, the writer expatiates what trademark dilution is and how to judge trademark dilution. In the second part, he sums up how to protect well-known trademarks in western countries and national society. In the third part, he analyses the disadvantages of trademark anti-dilution protection in Chinese. In the last part, he explores ways of protecting well- known trademarks.
