《民法典》物权编中新增的居住权制度是对居住权的社会价值、司法价值的正向回应，有助于“住有所居”目标的实现。随着《民法典》的正式生效，我国已步入以民法典作为规制基础的法典化治理时代，如何从立法无缝衔接到解释适用是现阶段首要任务。本文梳理居住权规范的内在逻辑后，分别以“居住权的设立”、“居住权的内容”、“居住权的消灭”为视角对38份样本案例进行分析，围绕现有规范中存在的法律漏洞与居住权制度在实践中涉及的裁判问题展开讨论；通过区分遗嘱继承与遗赠设立居住权的公示效力、公证制度解决“自有居住权”交易风险、依据产权构成厘清居住权客体范围、订立三方协议实现居住权的流转以及创设法定债之移转等方式拓展居住权之社会保障功能，发掘居住权之投资消费功能。

The residency right system newly added in the property rights section of the Civil Code is a positive response to the social and judicial value of residence rights, and is conducive to the realization of the goal of "living where you live". With the official entry into force of the Civil Code, China has entered the era of codified governance with the Civil Code as the basis for regulation. How to seamlessly link legislation to interpretation and application is the primary task at this stage. After sorting out the internal logic of residency norms, this paper analyzes 38 sample cases from the perspectives of "establishment of the residency right ", "content of the residency right ", and "elimination of the residency right ". Discuss the loopholes and the adjudication issues involved in the residency system in practice; by distinguishing the publicity effect of wills and bequests to establish residency, the notarization system solves the transaction risk of "own residency", and clarifies the scope of residency objects based on the composition of property rights . Entering into a tripartite agreement to realize the transfer of residence rights and the transfer of legal debts to expand the social security function of residence rights and explore the investment and consumption functions of residence rights.
