本文试从《侵权责任法》的视角，跨越法学、教育学、学校管理学领域，对当前我国未成年学生校园伤害中教育机构的法律责任问题进行分析。全文共分五个部分进行分析。第一部分：未成年学生校园伤害教育机构责任认定的法律框架。这一部分对学生伤害事故学校责任承担的法律框架进行了梳理。第二部分：未成年学生校园伤害法律责任概述。这一部分对未成年学生校园伤害法律责任的概念、适用范围、归责原则以及教育机构的教育、管理职责等问题进行了介绍。第三部分：未成年学生校园伤害中教育机构法律责任的构成要件。这一部分首先对教育机构法律责任的四个构成要件进行了归纳，然后对未成年学生校园伤害的责任主体进行了考察，最后对未成年学生校园伤害的责任形式进行了分析。第四部分：未成年学生校园伤害的损害赔偿规则与抗辩事由。这一部分主要分析了未成年学生校园伤害的赔偿规则与赔偿范围、第三人侵权与教育机构的补充责任以及未成年学生校园伤害的抗辩事由。第五部分：《侵权责任法》实施后教育机构在此类事件中面临的主要问题。这一部分首先总结了《侵权责任法》就教育机构责任的立法思路，在此基础上提出了新形势下教育机构学校如何预防、应对校园伤害事故的一些对策和建议。

From the perspective of the Tort Liability Act, the author analysis the legal responsibility of education institutions in campus injury about minor students, using the knowledge of law, education, and school management, This paper composes of five chapters for analysis： Chapter one: the legal responsibility identification of education institutions in campus injury about minor students. This chapter defines the legal framework of the legal responsibility of education institutions in campus injury about minor students. Chapter two: overview on the legal responsibility of education institutions in campus injury about minor students. This chapter introduces the concept, scope of application, the principle of imputation, education and management responsibilities of education institutions. Chapter three: the components of the legal responsibility of education institutions in campus injury about minor students. Firstly, this chapter concludes four constitutive requirements of education institutions of legal responsibility. Secondly, this chapter investigates the liability subject of campus injury about minor students. Thirdly, this chapter analyses the liability form of campus injury about minor students. Chapter four: the damage compensation rules and the plea instance of campus injury about minor students. This chapter mainly analyses compensation rules and compensation scope of campus injury about minor students, a third party infringement and additional responsibility of education institutions and the plea instance of campus injury about minor students. Chapter five: the main problems education institutions will face after the tort liability law implanting in such events. This part firstly summarizes the legislative idea of the tort liability law on responsibility of education institutions. Based on this, this chapter advances some countermeasures and Suggestions that how education institutions prevent and deal with campus injury about minor students under the new situation.
