基于网络实施的暴力行为一直屡禁不止。在新冠疫情爆发以后，随着互联网的普及，针对教师这一特定群体的新型案件——网暴教师案件数量也开始增多，并对教师群体的身心健康造成了严重影响。这类案件受教育、文化、情绪等因素影响，具有多为群体性作案、以欺凌为目的、行为人与受害人特殊等特点。现行刑法在面对这类案件时往往不能有效规制，限制了刑法保护机能在这类案件中的发挥。因此，为了使刑法保护机能得到有效发挥，可通过专门增设网络暴力罪、发挥公诉机关在取证中的作用等途径，让教师群体能够得到刑法保护，以维护社会稳定。

Such cases are influenced by education, culture, emotions and other factors, with the characteristics of group crime, bullying as the purpose, the perpetrator and the victim are special. In the face of such cases, the existing criminal law is often unable to regulate effectively, which limits the protection function of criminal law in such cases. Therefore, in order to give full play to the protection function of criminal law, teachers can be protected by criminal law through the special addition of the crime of Internet violence and the role of public prosecution organs in obtaining evidence, so as to maintain social stability.
