高校学生社团是学生自主享有结社权利，依据兴趣自愿组建的组织，在理论上属于民法上的非法人团体。现有的高校管理制度中将学生社团的定位为加强和改进大学生思想政治教育、服务学校改革和发展稳定的学生组织，并将对其的管理制度嵌入到高校的行政管理制度中，呈现出较强的依附性、党团主导性和全面而严格的管理体系等特点。这种管理制度使得学生社团内部缺少自治权及培育自治权的内生动力，外部独立性受到高校管理部门的侵害，以致于学生社团不能有效发挥其对学生个人成长、弥补高校课堂教育、加强学生和学校与社会联系等功能。如何发挥学生社团的应有功能，实现高校学生社团管理制度的法治化是本文的需要解决的问题。本文拟从学生社团的法律性质及法律地位出发，界定学生社团应享有的法律权利，分析学生社团在当前管理制度中的地位，其中着重分析学生社团的非法人团体性质及其与法人社团的区别。其次，以北京师范大学为例，详述当前我国高校学生社团管理制度的实际运行情况。重点分析该管理制度存在的高校管控目的与学生社团自主发展的冲突、管理内容重管控轻服务、自上而下的官僚式的管理方式等问题。进而从高校和学生社团两方面剖析问题产生的原因。最后提出合理化建议。通过明确大学自主权，实现大学的自主独立，之后确立学生在高校中的主体地位，赋予并尊重学生社团的独立地位，确立学生社团在高校民主治理结构中的参与地位，维护其自主权。并根据不同学生社团的成熟程度，尝试建立学生社团的法人化机制，以期实现学生社团独立自主的发展。

The college student association is a student enjoys the right of association, according to the interests and voluntary formation of organization.Theory on civil law, it’s a non corporate body.The management system of colleges and universities existing positioning students associations to strengthen and improve the ideological and political education of college students, student organizations service the development of school reform，And its management system embedded in the university administration system, showing a strong dependence, the leading by Communist Party of China and The communist youth league of China, and comprehensive and strict management system etc..This management system makes the students lack autonomy and cultivate the autonomy of the internal power, external independence is violated by the management department , so that students can not effectively play the function of students' personal growth, to make up for college classroom education, strengthen the student and the school and society etc.How to play the function of Student Association, University Students' community management system under the rule of law is the problem to be solved.This article embarks from the legal nature and legal status of student association,define the scope of rights in student association,analysis the status of student association in the current management system,which focuses on analyzing the nature which focuses on analyzing the nature of non corporate body of student association and their difference from the body corporate.Secondly, a detailed analysis of the current practice of our country university student association management system, taking Beijing Normal University as an example.Focus on the analysis of the existing problems in community management system for college student association,such as the conflict between the control objective and independent development of student association;weight control and light services in the management content;Bureaucratic top-down management style etc.And then analyze the causes of the problem , from two aspects of colleges and students.Finally, put forward reasonable suggestions.Through clarifying the autonomy of University, realization of University's independence.Then establish the subject status of students in colleges and universities, to give and respect student association’s independent status.Establish the status of participation of student association in colleges and universities in the democratic governance structure, maintain it’s autonomy.And according to the degree of maturity of different student association, try to establish corporate mechanism of student association in order to realize the development of students stand on one's own.
