伴随着科技的发展，医疗水平不断提高，越来越多在过去被视为绝症的疾病被现代医学技术所攻讦，给病患带来了生的希望。然而还是存在着许多无法治愈的病症，不断折磨着病人的身体健康和精神健康，病人却只能选择延缓生命，而无权终止医疗。2022年6月23日，《深圳经济特区医疗条例》的修改，其中第78条首次以规范性文件的形式将“生前预嘱”纳入制度体系。作为试点先行的深圳，为推动生前预嘱进一步制度化、法治化奠定了基础。本文第一章辨析了生前预嘱的概念及其特征，并于相关概念进行比较，提出生前预嘱制度存在的意义，第二章对《医疗条例》78条进行评述，第三章介绍了域外生前预嘱制度，第四章提出一些完善我国生前预嘱制度的建议。

With the development of technology and the continuous improvement of medical standards, more and more diseases that were once considered incurable diseases are being criticized by modern medical technology, bringing hope to patients. However, there are still many incurable diseases that constantly torment the physical and mental health of patients. However, patients can only choose to delay their lives, but have no right to terminate medical treatment. On June 23, 2022, the "Shenzhen Special Economic Zone Medical Regulations" were amended, in which Article 78 incorporated "pre life advice" into the system in the form of a normative document for the first time. As a pilot city, Shenzhen has laid the foundation for further institutionalization and legalization of pre life orders. The first chapter of this article analyzes the concept and characteristics of pre life advice, and compares them with relevant concepts. The second chapter reviews Article 78 of the Medical Regulations, the third chapter introduces the pre life advice system outside of China, and the fourth chapter proposes some suggestions to improve China's pre life advice system.
