在家教育是有别于学校教育的一种教育形态。随着我国在家教育案例逐渐增多,在一定程度上对现行教育法律造成影响,加之其自身发展中存在的问题,有必要对其进行研究,从而回应社会热点问题,适应变革社会的教育法律诉求。本研究首先采用访谈法调研具有代表性的北京地区在家教育的现状,在家教育以其多样化的办学形式,较为丰富的课程内容,吸引学生参与的学习方式,父母学历背景与经济条件比较好,在家教育孩子自我满意度较高等特点昭示在家教育的优势,但是依据现行的法律其也存在在家教育相关利益主体面临违法困境,日常教学活动存在一定问题,学生接受高中教育与高等教育出路不畅等方面的问题。教育立法在破解在家教育相关主体的违法难题,为在家教育日常教育活动提供基本标准,促进其有序规范发展,赋予在家教育学生合法身份,保障其顺利接受高等教育等方面提供有效方式。义务教育阶段父母教育权处于缺失状态,在应然层面,义务教育阶段父母教育权具有合理性,有必要对在家教育进行立法,确保义务阶段父母教育权的合法性。关注教育多元化逐渐成为教育立法的价值取向,为父母提供多样化教育选择逐渐成为教育立法的重要指向,加之美国及我国台湾地区在家教育经历由不合法到对合法的历程,相关法律内容立法提供可资借鉴经验,因此,对在家教育进行立法具有可行性。在家教育存在的问题和国内外教育立法的经验基础上构建我国在家教育法律,第一,修订《中华人民共和国义务教育法》(以下简称《义务教育法》)相关条款;第二,探讨在家教育立法的重点内容,从基本原则、实施方式、实施对象、申请与审核、课程内容、学生学籍、学习成绩测评、教师资格、教育机构办学,政府及社会支持等方面提出立法构想。 |

Home schooling is a type of education form which is different from school education. With more and more cases of home schooling, it has influenced the current education law system in a certain extent. What’s more, due to the problems home schooling exists, it is necessary to study home schooling to respond to the social hot issues and adapt the educational legal requirement of social changes.I start by interview to investigate the current situation of home schooling in Beijing which is the most representative area. I find that the home schooling in Beijing has some advantages,such as its diverse forms of schooling, rich course contents, attracting students to participate in learning, parents' good educational background and economic conditions, children’s high level of self-satisfaction in home schooling and so on. However, there are still many problems for home schooling. For example, some stakeholders of home schooling are illegal according to the present law. In addition, there are some problems in the daily teaching activities. What are worse, students for home schooling may face obstacles when they receive the high school education and higher education.Educational legislation plays an important role in dealing with these problems, because it can solve the stakeholders’ illegal problem in home schooling, provide the basic standards for daily home educational activities to promote the orderly and standardized development of home schooling, and give the students legal status to ensure that they can be accepted by higher education smoothly. But now in compulsory education stage parents lack educational right which is reasonable in the level of it ought to be. So it is necessary to legislate for home schooling to ensure parents’ educational right. Besides, the diversified education is becoming the value orientation in educational legislation therefore parents’ right to educational selection has become an important direction. Moreover, the United States and Taiwan in home schooling have undergone a process from illegal to legal, and the contents of the legislation provide us good experiences, thus it is feasible for us to conduct home schooling legislation.We should construct the law of home schooling based on the problems it faces and the lawmaking experiences both at home and abroad. On the one hand, we can amend the relevant provisions in the compulsory education law of the People's Republic of China (hereinafter referred to as law of compulsory education). On the other hand, we should explore the key contents of the legislation. I propose that we can construct the concept of legislation from basic principles, implementation, application and auditing, the course contents, the student status, learning assessment, teacher qualifications, education institutions, government and social support, etc. |
