在高压反腐的新形势下，高校腐败问题逐渐凸显，其中科研经费腐败成为高校腐败的高发地。通过对中国裁判文书网收录的党的十八大以来高校科研经费腐败犯罪案件样本实证分析，我们发现司法判决与社会发展态势和民众的期待还存在一定的距离。对于刑法分则中职务性财产犯罪的构成要件，要结合其所保护的法益在总则的框架下进行解释，禁止一刀切式地将非法占有科研经费的行为定性为贪污罪。高校科研经费腐败根源相对复杂，同时刑罚作为事后惩治手段具有一定的局限性，未来应当构建事前积极预防、事中严密监督、事后严格惩治的系统性、科学性、全方位的高校科研经费腐败犯罪治理体系。

Confronting the big fight against corruption, the corruption cases occurred in colleges and universities has gradually become prominent, among which the corruption regarding scientific research funds accounts for a large proportion. Since the 18th CPC National Congress, based on the analysis of the corruption cases regarding scientific research funds of colleges and university, we could find that it is difficult to follow the steps of the society,and that there is still a long way to go. As for the crime of public property violation by taking advantage of one’s office in Criminal Law, the constitutive elements shall be interpreted within the framework of the General Provisions in combination with the legal interests it protects. And the the behavior of illegal appropriation of scientific research funds shall not be defined as the crime of embezzlement without concerning the different circumstance .The corruption of scientific research funds in colleges and universities has complex roots. Besides, Punishment only has certain limitations. In the future, a comprehensive, systematic and scientific governance system to fight and decrease the scientific research funds corruption crime in colleges and universities shall be established, which includes prevention in advance, supervision in the whole period and punishment after the occurrence.
