短视频是一种内容碎片化程度较高、拍摄道具简单、具有较强社交属性且具有一定时长限制的新型视频形式，可以根据创作基础分为原创型短视频和二创型短视频。本文以短视频从创作之初到最终维权的发展为脉络，分别探讨短视频是否具有作品性、短视频著作权权属问题、二创型短视频合理使用制度以及短视频平台责任义务划分。着重研究二创型短视频适用合理使用制度的混乱以及短视频平台责任义务过低等问题，并提出相应的解决办法，加大对短视频著作权保护的力度，为短视频行业提供更为完善的法律保障，促进行业整体平稳健康发展。

Short video is a new type of video form with a high degree of content fragmentation, simple shooting props, strong social attributes and certain time limitations, which can be divided into original short video and secondary short video according to the basis of creation. This article takes the development of short videos from the beginning of creation to the final rights protection as a vein, and discusses whether short videos have the nature of works, the copyright ownership of short videos, the fair use system of secondary short videos, and the division of responsibilities and obligations of short video platforms. It focuses on the confusion of applying the fair use system to short videos of secondary creation and the low responsibility of short video platforms and puts forward corresponding solutions to increase the strength of short video copyright protection, provide more perfect legal protection for the short video industry, and promote the smooth and healthy development of the industry as a whole.
