随着经济的发展和人们观念的演变，个人破产余债免除制度日益被世界各国普遍地接受。余债免除制度有利于债务人“重新开始”，从长远、整体的角度来看也有利于债权人利益和整体社会利益的维护。我国经济正面临迫切的债务化解需求，司法中“执行难”问题亟待解决，现代破产法也有保护债务人的价值取向，可见我国有建立余债免除制度的必要。与此同时，我国不断完善的个人信用体系和已有的法律法规、司法实践经验为这一制度的建立创造了条件。健全、谨慎的制度设计能够有效防止这一制度的滥用。我国应该在采取一般破产主义的基础上，设定严格的余债免除适用条件，在可免除债务的范围内，进行附条件的许可免责。

At the same time, the developing individual credit system, present law and practical experience create the conditions of the system. Besides, perfect design of the system can prevent it from abuse. Our country now has the necessity and sufficient conditions for establishing the individual bankruptcy residual debt exemption system.
