由于经济社会的高速发展,房产等不动产成为了人们财产结构的重要组成部分。不动产物权登记制度是我国物权法中的重要制度,在不动产物权的变动中起着举足轻重的作用,而登记审查模式是不动产物权登记制度的重要组成部分。为了维护正常的不动产交易秩序,保护人民财产安全,不动产登记的审查模式的选择即采取实质审查还是形式审查便成为制度制定时的重大命题。不动产登记这一准法律行为使物权变动具有公信力,对于不动产登记审查模式的问题,从我国不动产登记的实际状况和法治状态来看,简单的把不动产登记的审查方式定位于形式审查或者是实质审查都是不科学的。本文在物权法相关理论的指导下,通过案例分析、比较研究的研究方法,对不动产物权登记的基础理论、性质、法律效力及当前世界各国的立法情况进行深入阐述,分析我国不动产登记审查模式的缺陷,从而有针对性的完善我国的不动产物权登记审查制度。特此,希望通过对不动产物权审查模式研究,寻求基于形式审查的一种实质性转型,从而更好的实现不动产交易安全,进一步对不动产物权登记制度在实践中的规范运行做出理论上的贡献。文章共有四章:第一章为不动产登记审查制度的一般理论,分析界定不动产登记的理论基础、行为性质及其法律效力等内容。第二章为不动产登记审查模式分析。通过对国外不动产登记审查模式的比较,探讨如何选择适合我国国情的审查模式。第三章是对我国不动产登记审查模式之现状分析。结合我国《物权法》中不动产登记审查制的相关规定,分析我国不动产登记审查模式的现状及当前存在的缺陷等问题。第四章为我国不动产物权登记审查模式完善的几点建议。基于我国现行不动产物权登记审查模式存在的缺陷进行有针对性的分析、提出完善我国不动产物权登记审查制度的相关建议。

With the rapid economic and social development, real estate and other real estate becomes an important part of property structure. Real property registration system in China is an important system in the property law, in real right change plays an irreplaceable role, while the registration examination mode is real property registration system is an important part of. In order to maintain the normal real estate transaction order, protect people and property safety, real estate registration review mode should take substantive examination or review form becomes a system developed at a time when great proposition. Real estate registration which could enable the change of legal behavior with credibility, for real estate registration review model, from the registration of real estate in China 's actual situation and the rule of law state, simply takes the real estate registration review positioning in the form of review or substantive examination is not scientific. In this paper, under the guidance of the theory of real right law, through the case analysis, comparison research method, the registration of property right theory, the nature, legal effect and the current various countries legislation are thoroughly described, analysis of China's real estate registration system defects, so as to improve our the registration system of real property. Hereby, I hope through to the immovable property review mode research based on formal review, seeking a substantial transformation, so as to better achieve the security of real estate transactions, further on the registration system of real property in the practice of standardized operation and make the theory contribution.The article consists of four chapters:The first chapter is the real estate registration and examination system of the general theory, analyzing the definition of real estate registration theory, behavior and its legal nature and validity of content.The second chapter is the real estate registration review mode analysis. Through the overseas real estate registration review model comparison, discusses how to choose the suitable national conditions of our country to examine the model.The third chapter is about the registration of real estate in China a review of model analysis. Combined with our" property law" in the real estate registration examination system of the relevant provisions, analysis of China's real estate registration review model present situation and existing problem.The fourth chapter is the our country's real estate registration review model and improving suggestions. Based on China's current real estate registration examination system defects targeted analysis, put forward to perfect our country's real estate registration system to review the related suggestions.
