我国的“垃圾革命”并不是一帆风顺的,在推进城市生活垃圾分类管理的过程中,出现了很多问题和障碍。本文通过整理我国的法律和近两年来北京、上海、广州出台的地方性法规,找到制约我国垃圾分类管理的制度因素:一是责任主体过于局限,欠缺生产者责任的延伸,二是收费模式过于僵硬,计量收费制仍有待落实,三是法律责任操作性差,缺少更严密的奖惩政策,四是垃圾分类回收率低,缺少相关经济激励机制。通过比较研究国外城市生活垃圾分类的法律制度,借鉴日本、德国、英国垃圾分类制度的经验,本文提出了完善我国城市生活垃圾分类管理法律制度的建议:一是加强顶层设计,健全生产者责任延伸制度、垃圾收费制度、押金返还制度、奖惩制度等垃圾分类管理的经济激励机制;二是完善执行机制,增强垃圾分类管理法律规定的实施效果,从而解决当前我国面临的“垃圾困境”。

China's "garbage revolution" has not been smooth, and many problems and obstacles have emerged in the process of promoting the classification and management of urban domestic garbage. This article finds out the institutional factors restricting China's waste classification management by sorting out our laws and the local regulations issued in Beijing, Shanghai, and Guangzhou in the past two years: one is that a complete legislative system has not been formed; There is no long-term incentive mechanism. By comparatively studying the legal systems of municipal solid waste classification in foreign countries, and drawing on the experience of the Japanese, German, and British garbage classification systems, this article proposes suggestions for improving the legal system of municipal solid waste classification management in China: The first is to strengthen the top-level design and improve the economic incentive mechanism for waste classification management such as producer responsibility extension system, garbage charging system, deposit refund system, reward and punishment system; The "garbage dilemma" currently facing China.
