近年来,“盲盒”在中国掀起热潮,“盲盒+”的营销模式应运而生。伴随着诸多新式盲盒的出现,行业乱象也由此产生。“食品盲盒”由盲盒衍生发展而来,是将食品以盲盒形式出售的商品,从法律性质的角度来分析,一类可以定性为典型的买卖合同(实定合同),另一类则可以定性为射幸合同。射幸类的食品盲盒市场存在失灵的情况,具体体现为严重的信息不对称以及市场交易的外部性。为了克服市场失灵、弥补市场机制的局限性,就需要对其进行行政规制。

在食品盲盒行政规制的完善方面,由于行政规制活动必须遵循比例原则,因此首先要对食品盲盒进行风险分级,根据出售的食品的类别、消费对象等因素将食品盲盒划分为四个风险等级,对不同风险等级的食品盲盒采取与之相适应的规制工具。具体来说,可采用标准和强制信息披露这两个规制工具:应制定输入标准,禁止高风险食品盲盒的生产经营活动,应根据食品盲盒的不同风险等级,结合各自的特性,在包装、食品标签、存放条件、价格范围等各方面,制定不同的具体的标准;允许被生产经营的各风险等级的食品盲盒均应对有关食品安全质量、概率、价格等的信息进行强制披露,对于风险等级较高的食品盲盒产品,还应做出安全风险警示和提示,说明产品风险。

In recent years, “blind boxes” have become a craze in China, and the new marketing model of “blind boxes+” has emerged. Along with the emergence of many new forms of blind boxes, market confusion has arisen. Derived from the blind box, the blind box of food is a commodity which food is sold in the form of a blind box. From the perspective of legal nature, one type can be characterized as a typical sales contract (certain contract), while the other can be characterized as an aleatory contract. There are market failures for the blind box of food of the aleatory contract type, as evidenced by severe information asymmetries and externalities in market transactions. In order to overcome the market failure and compensate for the limitations of the market mechanism, governmental regulation is needed.

In terms of the improvement of governmental regulation of the blind box of food, since governmental regulation activities must follow the principle of proportionality, the blind box of food must be classified prior to regulation. According to the type of food, the consumer and other factors, the blind box of food can be categorized into four risk levels, and then the different risk levels of the blind box of food should be taken with the appropriate regulatory tools. Specifically, two regulatory tools of standards and mandatory information disclosure can be used. Input standards should be developed to prohibit the production and operation of high-risk blind boxes of food. Different specific standards should also be developed according to the different risk levels, taking into account their respective characteristics in various aspects such as packaging, food labeling, storage conditions, price range, etc. In addition, allows the production and operation of each risk level of the blind box of food should be mandatory disclosure of information about food safety quality, probability, price, etc. For higher risk levels of the blind box of food, should make safety risk warnings and tips.
