随着互联网和物联网的迅速发展,数据已经成为现代社会各个方面不可或缺的新型生产要素;同时,用户个体对个人数据的所有权和隐私保护的需求与期望日益凸显。数据可携权赋予了个人获取或转移其向数据控制者提供的数据的权利,欧盟出台《通用数据保护条例》为世界范围内数据可携的实践提供了参考,而数据可携权在中国的本土化实践同样具有重要的理论和现实意义。数据可携权的研究涉及法律、经济、技术和管理等多个领域,目前关于数据可携权的研究较多集中在法学层面上的宏观探讨,因此有待进一步整合跨学科的研究方法和视角对其进行分析,探讨不同领域下数据可携权的影响机制和互动关系。

本研究旨在从利益相关者视角出发,探讨数据可携权在中国的本土化可能性和治理路径,为具体的实践提供理论支撑和模式思路。在理论层面上,采用了参与式观察与深度访谈法,以利益相关者视角展开数据可携权实行中的权力与利益角色分析;在实践角度上,通过某外卖平台的数据共享探索的案例分析,探索数据可携的案例实践思路。研究发现,数据可携权本土化主要的利益主体包括平台企业、用户个人、政府、第三方科研机构、行业协会与组织以及媒体,在确定其数据可携的角色身份时发现,作为数据控制者、处理者和接收者的平台企业是诸多主体中的核心利益相关者;基于这一结论,以某外卖平台的数据使用与治理为案例,分析平台企业在数据可携方面的关键作用,认为需要其针对数据可携权在专门负责、加密传输、强化审核等方面持续迭代。通过案例分析,并结合各利益相关者的协调视角,本研究认为需要采用中心化与平衡化相结合的数据可携治理模式,以吸引相关利益主体的共同参与。

本研究的创新点在于以数据可携权这一新兴权力为研究对象,从较为积极的角度出发探究其本土化的可能性,在研究视角上借助利益相关者理论对数字治理主体展开分析,并尝试提出了数据可携本土化的治理模式。

With the rapid development of the Internet and the Internet of Things, data has emerged as a new type of production factor deeply integrated into all aspects of modern society. Concurrently, the needs and expectations of data subjects for the ownership and privacy protection of personal data have become increasingly prominent. The right to data portability gives individuals the right to access or transfer the data they have provided to the data controller. The introduction of the General Data Protection Regulation by the European Union provides a reference for the practice of data portability worldwide, and the localized practice of the right to data portability in China is also of great theoretical and practical significance. The study of data portability involves multiple fields such as law, economy, technology, and management. Currently, research on data portability focuses on macro discussions of law and proposes legislative and regulatory policies applicable to governments and regulators. Therefore, there is a need to further integrate interdisciplinary research methods and perspectives to analyze it and explore the influence mechanism and interactive relationship of the right to data portability in different fields.

This study aims to explore the localization possibilities and governance paths of data portability rights in China from a stakeholder perspective, providing theoretical support and model ideas for specific practices. At the theoretical level, participatory observation and in-depth interviews are used to analyze the roles of power and interests in the implementation of the right to data portability from the perspective of stakeholders. At the practical level, a case study of a food-delivery platform's exploration of data sharing is conducted to explore the ideas of data portability practice. The study finds that the main interested parties in the localization of the right to data portability include platform enterprises, individual users, the government, third-party scientific research institutes, industry associations and organizations, and the media. In the identification of their roles, it is found that platform enterprises, as data controllers, data processors, and data receivers, are the core stakeholders among the many parties. Based on this conclusion, the study explores the role that platform enterprises should play in the implementation of the right to data portability using the case study of a food-delivery platform's data use and governance. The study suggests that for platform enterprises to play a key role in data portability, they are required to continue iterating on specialized responsibility, encrypted transmission, and enhanced auditing, especially for the right to data portability. Through a case study and incorporating the coordination perspective of various stakeholders, this study argues that a data portability governance model combining centrality and equilibrium is needed to attract the joint participation of relevant stakeholders.

The innovation of this study lies in taking the emerging power of data portability as the research object, exploring the possibility of its localization from a more positive perspective, analyzing the subjects of digital governance with the help of stakeholder theory, and proposing a localized governance model of data portability.
