我国《合同法》在第410条规定了委托合同双方当事人均享有任意解除权。然而随着经济与社会的发展，这一规定也产生了许多问题。在早期，我国的委托合同以无偿为主，而现在，有偿的委托合同所占的比重早已超过无偿的委托合同。在有偿的委托合同中，委托人和受托人也都享有委托合同的任意解除权，在实务操作中出现了很多一方当事人解除合同损害另一方的行为。因此有些当事人会在委托合同的条款中加上不可撤销条款（此处的“不可撤销”即“不可解除”），不过这种行为在学界和司法判决中也出现了不同的观点，主要争议在于以下几点：第一，委托合同任意解除权的法理基础是什么，是基于信赖还是无偿性；第二，当事人放弃任意解除权是否有效，是否对无偿委托和有偿委托都适用；第三，有哪些要限制任意解除的情形。笔者认为，任意解除权是基于当事人之间的信赖，且双方当事人放弃任意解除权的约定是有效的。本文希望在分析以上问题和我国委托合同相关法律制度的不足后给出自己的一些建议。

In the Article 410 of the Contract Law of China, both of the parties of the commission contract have the discretionary right to terminate the contract. However, with the economic and social development, this regulation has also produced many problems. In the early time in the society of China, most of the commission contracts were gratuitous. But now, the proportion of the paid commission contract has already exceeded the gratuitous ones. In the non-gratuitous commission contracts, both of the parties of the commission contract have the discretionary right, and in some cases, one party may use this power to hurt the other part’s interests. Some people add an irrevocable clause in the commission contract. But different courts and different scholars have different ideas. The main dispute is the following points: first, what is the legal basis of the discretionary right. Second, can the parties of the commission contract abandon the discretionary rights? Third, what are the other restrictions should be taken into account? I think that the legal basis of the discretionary right is the trust and the parties can abandon the discretionary rights. This paper is intended to talk about these questions and give the advice about the shortages of the regulations about the commission contract.
