随着科技与时代的快速发展,公众的驾驶方式发生了巨大的变化,更为方便的自动驾驶横空出世,为交通犯罪这一传统犯罪领域制作了一片新兴的理论空白。本文以林文钦蔚来车祸案引入,聚焦于这一最新驾驶模式,共分为三个部分进行论述:第一部分通过具体案例的引入,归纳其中存在的具体争议点,提出NPO系统的性质和案件中信息的披露两个主要矛盾。第二部分分析前文提出的争议,确定NPO系统为L3级别的自动驾驶,并以此为前提,根据具体案情分析案件中的刑事责任主体和宣传问题。同时,分析车载信息的共享对犯罪预防和犯罪调查两方面的重要作用。第三部分给出行之有效的建议,综合刑事犯罪的具体特点,从犯罪预防、责任承担等方面进一步完善自动驾驶中的刑事规制,维护道路安全、助力产业发展。 |

With the rapid development of technology nowadays, the public's driving style has changed dramatically, and the more convenient autonomous driving has emerged across the board, producing an emerging theoretical gap in the traditional crime field of traffic crimes. This paper is introduced by the case of Lin Wenqin Azure car accident, focusing on this latest driving model, and is divided into three parts for discussion: the first part summarizes the specific controversial points existing in it through the introduction of a specific case, and puts forward the two main contradictions of the character of the NPO system and the disclosure of information in the case. The second part analyzes the controversies raised in the previous section, identifies the NPO system as L3 level autonomous driving, and takes this as a premise to analyze the subject of criminal responsibility and publicity issues in the case according to the specific case. Also, this section analyzes the important role of in-car information sharing for both crime prevention and crime investigation. The third part gives proven suggestions to integrate the specific characteristics of criminal offenses and further improve the regulation of criminal liability in autonomous driving in terms of crime prevention and liability assumption to maintain road safety and help industrial development. |
