我国现行刑法中的单位犯罪刑罚体系存在较多缺陷，其中最为显著的，一是保留单罚制的处罚形式，二是刑种单一且罚金刑本身存在较多问题。借鉴国外的理论研究成果和立法先例，我国的单位犯罪刑罚体系改革应该以刑罚方式多样化和刑罚执行弹性化为目标，统一实行双罚制，完善罚金刑，并且设置多元化的刑罚方式，将缓刑制度和社区矫正制度引入单位犯罪的刑罚执行过程。

There are many defects in our current punishment system of unit crime, the application of single punishment system, the restricted categories of sanctions and defects in criminal fines are the most significant. Referring to theories and legislation abroad, this article holds that the reform should aim at the diversification of sanctions and the flexibility of execution, including(1) abolition of the single punishment system and perfection of fines,(2)new kinds of punishments should be designed and(3)corporate probation and community correction should be introduced to the procedure of penalty execution.
