新闻传播业态的飞速发展推动短视频成为主要传播手段之一，但我国著作权法的相关规范尚有不完善之处。二次创作短视频因其类型复杂、形式多样成为著作权法规范的模糊地带，而利用在先作品进行二次创作，更难以明确进行著作权侵权认定。对此，仍需以《中华人民共和国著作权法》第24条为依据，结合市场经济背景以及短视频在商业性以外的其他属性综合考虑。规制二次创作短视频的最有效路径是携手平台共同规制，为此需要明确平台责任，纳入网络版权内容过滤技术进行高效、低成本的侵权规制。

The rapid development of news communication industry has promoted short video to become one of the main means of communication, and the relevant norms of China's copyright law are still imperfect. Due to the complex types and forms, short video has become the fuzzy zone of copyright law, and it is more difficult to clearly identify copyright infringement to use previous works for secondary creation. The infringement of the secondary creation of short video should be based on Article 24 of the Copyright Law of the People's Republic of China, combined with the background of market economy and other attributes of short video other than commercial. The most effective way for the infringement regulation of secondary creation of short videos is to regulate it together with the platform. Therefore, it is necessary to clarify the responsibility of the platform and incorporate the network copyright content filtering technology for efficient and low-cost infringement regulation.
